s1 2 s3 Coal Mining Safety and Health Amendment Regulation No. 252, 2007 (No. 2) 2007 1 Short title This regulation may be cited as the Coal Mining Safety and Health Amendment Regulation (No. 2) 2007 . 2 Regulation amended This regulation amends the CoalMiningSafetyandHealthRegulation 2001. 3 Amendment of s 42 (Safety and health management system for personal fatigue and other physical and psychological impairment, and drugs) (1) Section 42— insert— ‘(6A) If the fitness provisions provide for the assessment of workers for a matter mentioned in subsection (1)(a) or (b), the site senior executive must establish the criteria for the assessment in agreement with a majority of workers at the mine.’. (2) Section 42(7), ‘subsection (1)’— omit, insert— ‘subsection (1)(c)’. (3) Section 42(7A), ‘section (7)’— omit, insert— ‘subsection (7)’.
