2 Coal Mining (General Rules for Open-cut Coal Mines) Amendment (No. 1) No. 156, 1993 ˙ Short title 1. This rule may be cited as the Coal Mining (General Rules for Open-cut Coal Mines) Amendment Rule (No. 1) 1993 . ˙ Amended rule 2. The General Rules for Open-cut Coal Mines 1988 are amended as set out in this rule. ˙ Replacement of ss.1.1–1.3 3. Sections 1.1 to 1.3— omit, insert— ˙ ‘Short title ‘1.1 This rule may be cited as the Coal Mining (General Rules for Open-cut Coal Mines) Rule 1988 . ˙ ‘Application of rule ‘1.2 This rule applies to open-cut coal mines. ’. ˙ Amendment of s.1.4 (Interpretation) 4. Section 1.4 (definition “trainee shotfirer” )— omit, insert— ‘ “trainee shotfirer” means a person at a mine who— (a) has turned 18 years; and (b) is appointed by the manager of the mine as a trainee shotfirer under section 6.7. ’. ˙ Replacement of s.6.7 (Shotfirers, assistant shotfirers and trainee shotfirers) 5. 3 Coal Mining (General Rules for Open-cut Coal Mines) Amendment (No. 1) No. 156, 1993 omit, insert— ˙ ‘Appointment of shotfirers, shotfirers’ assistants and trainee shotfirers ‘6.7(1) The manager of a mine must not appoint a person as a shotfirer unless the person— (a) has been trained in shotfiring techniques appropriate to open-cut coal mining; and (b) holds the qualifications necessary to obtain a shotfirer’s licence under the Explosives Regulation 1955 in a category appropriate to the work to be performed at the mine. Maximum penalty—4 penalty units. ‘(2) The manager may appoint a person as a shotfirer’s assistant or a trainee shotfirer. ‘(3) The manager must not fail to keep a record of the name of each person appointed by the manager as a shotfirer, shotfirer’s assistant or trainee shotfirer. Maximum penalty—4 penalty units. ˙ ‘Trainee shotfirers may be assigned to shotfirers ‘6.7A(1) The manager of a mine may assign a trainee shotfirer to a particular shotfirer. ‘(2) The manager must not assign to a shotfirer more trainee shotfirers than the shotfirer can adequately supervise having regard to the nature of the shotfiring work that is to be undertaken by those persons. Maximum penalty—4 penalty units. ˙ ‘Who may charge and fire explosives ‘6.7B(1) A person must not charge, load or fire an explosive unless the person is— (a) a shotfirer; or (b) a trainee shotfirer acting under the direct supervision of a
4 Coal Mining (General Rules for Open-cut Coal Mines) Amendment (No. 1) No. 156, 1993 shotfirer. ‘(2) A shotfirer or trainee shotfirer must not fire an explosive unless the shotfirer or trainee complies with the requirements of the scheme for the charging and firing of shots established under section 6.6. ‘(3) A person must not provide assistance to a shotfirer in charging or loading an explosive unless the person is— (a) a shotfirer’s assistant; or (b) a trainee shotfirer; trained in accordance with the requirements of the scheme for the charging and firing of shots established under section 6.6. ‘(4) A person other than a person mentioned in subsection (1) or (3)(a) must not charge or load an explosive.
