2 Coal Mining Exemption (No. 1) No. 224, 1992 ˙ Short title 1. This order in council may be cited as the Coal Mining Exemption Order (No. 1) 1992 . ˙ Definitions 2. In this order in council— “inspector” means the inspector of the district in which Mining Lease No.1775 is situated; “mine” means the mine that is the subject of Mining Lease No.1775; “project” has the meaning given by the Workplace Health and Safety Act1989 ; “site” means the part of the mine hatched in green on map number PL107B lodged with the chief inspector. ˙ Site exempted 3. The site is exempted from the provisions of the Act for the purposes of a project. ˙ Limited access to mine 4.(1) The manager must take steps to ensure that a person working on the site has only limited access to the mine. (2) To ensure safety at the mine, access to the mine must be limited to that which is necessary to enable the person to gain access to the site. (3) The steps taken to ensure safety must be satisfactory to the inspector. ˙ Notification of completion of project 5.(1) The manager of the mine must notify the inspector of completion of the project. (2) The notice must be given within 7 days of the day of completion.
