2 Coal Mining Exemption No. 223, 1992 ˙ Short title 1. This order in council may be cited as the Coal Mining Exemption Order 1992 . ˙ Definitions 2. In this order in council— “inspector” means the inspector of the district in which Mining Lease No.1775 is situated; “mine” means the mine that is the subject of Mining Lease No. 1775; “project” has the meaning given by the Workplace Health and Safety Act1989 ; “site” means the part of the mine hatched in red on map number PL107B lodged with the chief inspector. ˙ Site exempted 3. The site is exempted from the provisions of the Act for the purposes of a project. ˙ Fencing of site 4.(1) The boundary of the mine surrounding the site must be fenced to prevent access to the mine from the site. (2) The fencing must be of a standard that the inspector thinks is satisfactory to prevent access to the mine from the site. ˙ Notification of completion of project 5.(1) The manager of the mine must notify the inspector of completion of the project. (2) The notice must be given within 7 days of the day of completion.
