2 Coal Mining Exemption (New Whitwood Mine) No. 348, 1992 ˙ Short title 1. This order in council may be cited as the Coal Mining Exemption (New Whitwood Mine) Order 1992 . ˙ Definitions 2. In this order in council— “inspector” means the inspector of the district in which Mining Lease No. 4558 is situated; “mine” means the mine that is the subject of Mining Lease No. 4558; “project” has the meaning given by the Workplace Health and Safety Act1989 ; “site” means the part of the mine outlined in red on plan number 838410 lodged with the chief inspector. ˙ Site exempted 3. The site is exempted from the provisions of the Act for the purposes of a project. ˙ Nature of project 4. The project is the dismantling and removal of the coal preparation plant on the site. ˙ Conditions of exemption 5.(1) The site must be fenced or signs must be erected to restrict access to the site. (2) The fencing or the signposting must be of a standard that the inspector considers is satisfactory to restrict access to the site. ˙ Notification of completion of project 6.(1) The manager of the mine must notify the inspector of the completion of the project.
