MINING. 1 E liz . II. No. 8, 1952. Coal Mining Acts Amendment Act. 463 An Act to Amend “The Coal Mining Acts, 1925 to “ 8n 1951,” in certain particulars. SIS [A ssented to 17 th A pril , 1952.] AoT 0P1952' E it enacted by the Queen’s Most Excellent Majesty, B by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. (1.) This Act may be cited as “ The Goal Mining short title Acts Amendment Act of 1952,” and shall be read as one instruction, with * “ The Goal Mining Acts, 1925 to 1951,” herein referred to as the Principal Act. (2.) The Principal Act and this Act may be cited collective collectively as “ The Goal Mining Acts, 1925 to 1952.” title- 2. Section fifty-six of the Principal Act is amended— Amendments (i.) By repealing subsection one of that section and 0 *' ' by inserting, in lieu of that repealed subsection, the following subsection, namely :— “ (2.) At every coal mine where electricity (other than an extra low pressure supply or a low-pressure supply as defined by the rules set forth in the Second Schedule to this Act) is used, or for any two or more of such coal mines included in a group of coal mines in the same locality or district owned or leased by the same owner or lessee, a certificated mine electrician shall be appointed in writing by the manager (or in the case of a group or part of a group, by the respective managers) to take charge of the whole of the electrical machinery, apparatus, and conductors in and about the mine or, as the case may be, mines : Provided that with respect to any mine or mines the Chief Inspector of Coal Mines may from time to time in writing grant (subject to the carrying out by a person, being a certificated mine electrician or the holder of a certificate under f “ The Electrical Workers Acts, 1927 to 1931,” authorising him to carry on the calling or occupation of an electrical mechanic or electrical fitter, of a periodical supervision, at such times as the Chief Inspector may specify or more often, with respect to the electrical machinery, apparatus, and conductors in and about the mine or mines in question) exemption from the provisions of this subsection for such period as the Chief Inspector determines and specifies therein.” * 16 G. 5 No. 30 and amending Acts, f 18 G. 5 No. 19 and amending Act.

By repealing subsection two of that section and by inserting, in lieu of that repealed subsection, the following subsection, namely :— “ (2.) Written notice of every appointment, for the purposes of subsection one of this section, of a certificated mine electrician and containing the appointee’s name and address shall forthwith upon the making of the appointment be delivered by the manager or managers concerned to the inspector of the district wherein the mine or mines in question are situated. . Moreover where any exemption referred to in the said subsection one is granted thereunder, written notice of every appointment or arrangement made with respect to the carrying out by a person of the periodical supervision subject to which the exemption is granted and containing the name and address of that person shall forthwith upon the making of the appointment or arrangement be delivered by the manager or managers concerned to the inspector of the district wherein the mine or mines in question are situated.” (iii.) By repealing in subsection three of that section the word “ The ” where such word first occurs and by inserting, in lieu of that repealed word, the words “ Subject to any exemption granted under subsection one of this section, the ” ; also by repealing in the said subsection three the words “ He shall ” and by inserting, in lieu of those repealed words, the words “ The certificated mine electrician or, where any exemption is granted under subsection one of this section the person carrying out the periodical supervision subject to which the exemption is granted,* shall ”. (iv.) By inserting in subsection four of that section after the words “ certificated mine electrician ” the words “ or the person carrying out a periodical supervision under any exemption granted under subsection one of this section (v.) By repealing subsection seven of that section and by inserting, in lieu of that repealed subsection, the following subsection, namely :— “ (7.) In this section the term “ certificated mine electrician ” used in relation to any mine means a person holding under this Act a certificate of competency as a mine electrician or a certificate of service entitling him to have charge of the electrical machinery, apparatus, and conductors in and about that coal mine.”
