B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- I. This Act may be cited as "The Coal Mining Short title A?t Amendment Act ~f .1928," and shall be r~ad as one : ~ ~ struction. wIth *" The Coal Mtmng Act of 1925," herem referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The Coal Mining Acts, 1925 to 1928." 2. The following amendments are made in the Amend: Princip'1 < 1 Act • .- tmheenPtarm. The following words and provisos are added to Section 11, ... subsection three of section eleven:- subsection 3. twen"tya- nodne syheaallrs,beonresnuecwh acbolendfiotironas fausrtthheer MteI· rnm· Istoerf ct E ee x rr t mta e i ~ Inn i c o a n seosf. deems equitabIe : Provided that the holder of a coal-mining lease who has duly performed and observed each and every the conditions, covenants, and stipulations of his lease (including in such term any renewal thereof granted under the provisions of the last preceding paragraph of this subsection) and has duly perfo"med and observed all provisions of this Act and any regulations there ~ o applicable to such lease, and who is in lawful possession thereof, may at the expiration of the period of such lease apply to the Minister for a renewal of the term of such lease, and if the Minister is satisfied that the applicant has duly performed and observed such con- ditions, covenants, and stipulations, and provisions as set out aforesaid, and that such applicant is in lawful possession of such lease, he shall grant a renewal of the term of such lease (hereinafter referred to as the "first renewal") to such applicant for a further period not * 16 Vie. No. 18, exceeding twenty-one years, on the same terms as may be in force with regard to coal-mining leases at the time of granting such first renewal: Providedfurther that the Minister, on the completion of the period of such first renewal and on being satisfied, as in the case of the application for such first renewal, shall in like manner grant a further renewal or renewals of such lease for a period or periods, as the case may be, not exceeding, in respect of each renewal, twenty-one years, as he thinks proper under the circumstances : Provided also that such further renewal or renewals of such lease shall-be granted on the same terms as may be in force with regard to coal-mining leases at the time of such further renewal or renewals. The aforesaid provisions shall extend and apply to a coal-mining lease issued under this Act or under the provisions of *" The Mining Act of 1898" or under any Act or Acts amending or in substitution of the provisions of the said last-mentioned Act." Section 56. (ii.) Section fifty-six is repealed and a new section is inserted in lieu thereof:- Appoint- "[56.] (1.) At every coal mine, or group of coal mceertnitfiocfated mines in the same locality or district owned or leased by mine the same owner or lessee, where the consumption of electricians. power exceeds fifty kilowatts, or where the pressure used exceeds the limit of low pressure under the rules in the Schedule to this Act, or at a mine where naked lights are prohibited notwithstanding that the con- sumption of power is less than fifty kilowatts, a certificated mine electrician shall be appointed in writing by the manager, to take charge of the whole of the electrical machinery, apparatus, and conductors in and about the mine or mines. Notice to inspector. (2.) Where a certificated mine electrician is required to be employed at any mine, the manager shall forthwith send to the inspector of the district wherein the mine is situated a written notice of such electrician's name and address. If necessary for the proper observance of such Appoint- rules, the manager shall. also appoint in writing an : : ~ ~ ~ ! t. assistant or assistants to the certificated mine electrician. The inspector shall forthwith be notified of any appointment made under this subsection. (5.) In the absence of the certificated mine Appoint- electrician for more than one day, the manager shall: ~ ~~ i~; te. appoint in writing a competent substitute who shall be responsible during his temporary absence; the manager shall notHy the inspector of such appointment. (6.) Nothing in the foregoing provisions shall apply Saving. and extend to any coal mine where power is used solely on the surface and the consumption of power does not exceed fifty kilowatts and does not exceed the limit of medium pressure. (7.) (iii.) (a) In subsection one of section fifty-seven, Amen~ ment the words "Third Schedule" are repealed and the words of sectIon 57. " Second Schedule" are inserted in lieu thereof. (b) In subsection six of the said section, the word " subsection" is repealed and the word "section" is inserted in lieu thereof. (iv.) After section fifty-seven the following sections Sections 57A, are inserted:- 57B,and57c. A certificate of service shall be gra~ ted service. by the Board of Examiners to all persons who satIsfy the Board that they have been employed as mine electricians for twelve months during the two years preceding the passing of *" The Coal Mining Act Amendment Act of 1928" : Provided that no certificate of service shall be granted by the Board after a period of twelve months has elapsed from the date of the passing of *" The Coal Mining Act Amendment Act of 1928." Nature of such ceI,tificates. (2.) Certificates of service shall be of three descriptions ;- (a) A general service certificate, which shall entitle the holder to have charge of the whole of the electrical machinery, apparatus, and conductors in and about a coal mine where either direct or alternating current is used; (b) A special service certificate which shall entitle the holder to have charge of the electrical machinery, apparatus, and conductors in and about a coal mine where only direct current is used; (c) A special service certificate, which shall entitle the holder to have charge of the electrical machinery, apparatus, and conductors in and about a coal mine where only alternating current is used." Section 74. (v.) In subsection six of section seventy-four, after the words" permit under" the words" this Act of" are inserted. Section 86. (vi.) In paragraph (c.) of subsection five of section eighty-six, the words" sho'Ying all stoping" are deleted Section 86A. (vii.) The following new section is inserted after section eighty-six ;- Discontinu. " [86A.] (1.) When in any coal mine or part thereof, aonpceeraotifons. or in the workings in any seam of coal or part thereof, mining operations are discontinued temporarily or permanently, the owner, agent, or manager shall, within one month of such temporary or permanent * 19 Geo. v. Coal Mining Act Amendment Act. discontinuation, send to the Inspector of Mines an "accurate plan of the workings of the mine or seam or part or parts showing- " (a) The boundaries of the mineral tract, leasehold or freehold, to be worked by the mine; the boundaries of the workings of the mine or seam, including not only the working faces but also all headings in advance thereof up to the time of the temporary or permanent discontinuation of mining operations; (b) The pillars of coal OF other mineral unworked ; (c) The position, direction, and extent of every known fault of every seam in the mine or of the seam, as the case may be, with its vertical throw and of every known washout and intrusive dyke; (d) The position of the workings with regard to the surface; (e) The general direction and rate of dip of the strata; (j) The depth of every shaft or bore, and the depth and thickness of every seam passed through in each shaft or bore, and a section of the strata sunk through or, if that is not reasonably practicable a section of every seam in the mine or of the seam, as the case" may be. (2.) Whenever it is intended to take out pillars in Taking out any part or parts of a coal mine, notice of such intention of pillars. shall be sent to the Inspector of Mines, accompanied by the plan and information aforesaid, within four weeks immediately before commencing to take them out." (a) The following provision is added to rule twenty- Rule 28. eight of the said Second Schedule ;- "Except with the permission of the Chief Inspector of Coal Mines, no internal combustion engine shall be introduced or worked underground in any coal mine after the passing of *" The Coal Mining Act Amendment Act of 1928." (b) In paragraph (b) of subclause one of rule ninety- seven, the words "rule ten" are deleted and the words " rule one hundred and three" are inserted in lieu thereof. Rule l07A. (c) The following rule is inserted after rule one hundred and seven of the said Second Schedule ; - Application "[107 A.] All applications for examination for certificates of fcooefrrtificate cBoomarpdetoefnEcyxaams imnienrse, ealceccotrmicpiaanniesdhabllyb-e forwarded to the Secretary, competency as mine electrician. (a) A certificate as an electrical fitter or electrical mechanic under *" The Electrical Workers Act of 1927 ;" and (b) Evidence of satisfactory 'experience gained by the applicant while employed on electrical work underground for not less than nine months during the preceding two years at a coal mine or coal mines where electric light and power are used underground.
