Coal Mining Act Amendment Act 1990, No. 42 853 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Coal Mining Act Amendment Act 1990. (2) In this Act, the Coal Mining Act 1925-1989 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Coal Mining Act 1925-1990. 2. Amendment of s. 3. Act does not apply to petroleum , natural gas, or mineral oil . Section 3 of the Principal Act is amended in subsection (1) by omitting from the second paragraph the words "of and the Second Schedule to this Act" and substituting the words "and any rule made pursuant to section 96 or 97". 3. Amendment of s. 3A. Application of Act. Section 3A of the Principal Act is amended by- (a) omitting subsection (1) and substituting the following subsection:- "(1) The Governor in Council may, by Order in Council, exempt any mine or part of a mine in respect of which a project within the meaning of the Workplace Health and Safety Act 1989 is undertaken from all or any of the provisions of this Act (other than this section) either absolutely or upon and subject to such conditions as are specified in the Order in Council."; (b) in subsection (2)- (i) inserting after the word "Any" the words "mine or"; (ii) inserting after the word "Act" the words "(other than this section)"; (c) adding at the end thereof the following subsection:- "(3) For so long as a mine or part of a mine remains exempt from the provisions of this Act pursuant to subsection (2), the mine or part, for the purposes of section 4 of the WorkplaceHealth and Safety Act 1989, is a mine to which this Act does not apply.". 4. Amendment of s. 56 . Section 56 of the Principal Act is amended in subsection (1) by omitting the words "pressure supply or a low- pressure supply as defined by the rules set forth in the Second Schedule to this Act" and substituting the words "voltage supply or a low voltage supply as may for the time being be defined by rules made pursuant to section 96".

Section 57 of the Principal Act is amended in subsection (1) by omitting paragraph (c) and the proviso thereto and substituting the following paragraph:- "(1) Rules made pursuant to section 96 relating to the granting , suspension or cancellation of or the imposition of conditions upon certificates, licenses and authorizations relating to coal mines apply to certificates, licenses and authorizations granted under this section.". 6. Amendment of s. 90 . Section 90 of the Principal Act is amended by omitting from subsection (4) the words "rule twenty-three of the Second Schedule to this Act" and substituting the words "rules made pursuant to section 96 relating to underground coal mines".
