Coal Mining Act Amendment Act 1976
906 ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE BEGIN AE No. 76 of 1976 An Act to amend the Coal Mining Act 1925-1974 in certain particulars [ASSENTED TO 14TH DECEMBER, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Coal Mining Act Amendment Act 1976. (2) The Coal Mining Act 1925-1974 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Coal Mining Act1925-1976.
Coal Mining Act Amendment Act 1976, No. 76 907 Z Amendment of s. 50. Section 50 of the Principal Act is amended by- (a) inserting after subsection (3) the following subsections:- " (3A) The owner or agent of a coal mine may appoint a superintendent who shall exercise authority over the manager in all matters relating to the operation of the mine. A person is not qualified for appointment as a superintendent unless he holds a certificate as a mine manager granted under this Act. (3n) The manager of a coal mine to whom any superintendent, owner or agent gives a direction that in the opinion of the manager will prejudice the health or safety of any person may require that the direction be given in writing.". 3. Amendment of s. 104 . Section 104 of the Principal Act is amended by, in subsection (2)- (a) inserting after the words "Act the " the word " superintendent,"; (b) inserting after the words " unless such " the word " superintendent,". 4. Amendment of s. 111. Section 1 I 1 of the Principal Act is amended by omitting subsection (2) and substituting the following subsection:- (2) Such rules- (a) may be' made- (i) to apply generally throughout the State or within any part or parts thereof; (ii) to apply to all coal mines or any class or number thereof; (b) may adopt wholly or partly and either by way of reference or express specification therein any of the standard rules, codes or specifications of the bodies known as the Standards Association of Australia, the British Standards Institution or a like body identified in the rules; and (c) may provide- (i) that the approval of the Chief Inspector is to be the standard applicable in respect of a particular matter; (ii) that an inspector May direct or allow a rule or part thereof to be varied or otherwise modified in respect of its application to the working of a particular coal mine.".
908 Coal Mining Act Amendment Act 1976,.No. 76 5. Amendment of First Schedule . The First Schedule to the Principal Act is amended by, in Part I, inserting after clause 19A the following clause:- "19B . Exemption . Providing for the granting of exemption or conditional exemption from compliance with the rules or any of them; the entitlements of persons so exempted; revocation of any exemption or conditional exemption so granted.".
