AN ACT to amend the Coal Mines Regulation Act,

1946-1951.

[ Assented to 1st October, 1962.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

Short title

and citation. 1. This Act may be cited as the Coal Mines

Regulation Act Amendment Act, 1962.

(2) In this Act the Coal Mines Regulation Act,

1946-1951, is referred to as the principal Act.

(3) The principal Act as amended by this Act may

be cited as the Coal Mines Regulation Act, 1946-1962.

2. Section thirty-eight of the principal Act is undo,.

amended

(a) by substituting for the passage commenc- ing with the word, "miners" in line two of subsection (1) down to and including the word, "working" in line eight of that sub- section the following passage

persons who during the course of their duties as employees of coal mines in Western Australia

(a) suffer personal injury by accident arising out of or in the course of the employment; or

(b) contract any disease,

for which they are eligible to receive compensation under the provisions of the Workers' Compensation Act, 1912, and for the relief of the families of employees who have been killed by such accident or who have died from any such disease, ;

(b) by substituting for the words, "working in" in line four of subsection (2) the words, "who are employees of";

(c) by substituting for the words, "accident orthe contraction of any disease" in lines six

and seven of subsection (2) the passage, "personal injury by accident or the contrac- tion of any disease, during the course of their duties as such employees and";

(d)	by inserting after the word, "Act" in line eight of subsection (2) the passage, ", 1912,";
(e)	by substituting for the words, "have been injured" in line eight of subsection (4) the passage, ", during the course of their duties as employees of coal mines, have suffered personal injury by accident arising out of or in the course of the employment";

(f)	by inserting after the word, "Act" in line ten of subsection (4) the passage, ", 1912,"; and
(g)	by inserting after the word, "by" in line eleven of subsection (4) the word, "such".
