AN ACT to amend section sixty-seven of the Coal Mines Regulation Act, 1902-1926, and to vali- date certain contributions heretofore paid by em- ployees under the said section.

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

This Act may be cited as the Coal Mines Regula- tion Act Amendment Act, 1940, and shall be read as one

with the Coal Mines Regulation Act, 1902-1926 (No. 25 of 1902 as reprinted in the Appendix to the Sessional Volume of the Statutes for the year 1926 and amended by the Act No. 44 of 1928), hereinafter referred to as the principal Act.

Amendment

of s. 67 2. Section sixty-seven of the principal Act is amended

as follows :-

(a)	by inserting in subsection (2) after the word "shilling," in line three of the said subsection, the words "and sixpence";
(b)	by deleting from subsection (2) the words "six- pence," in lines four and five of the said sub- section, and inserting in lieu thereof the words "ninepence."

Contributions	3. Insofar as employees (including boys) purporting to act in compliance with subsection (2) of section sixty- seven of the principal Act, have, prior to the commence-

ment of this Act, contributed to the Coal Mines Accident Relief Fund any amounts at rates in excess of the rates specified in the said subsection as then in force, such amounts shall be deemed to have been properly and validly so contributed, and shall be deemed to have been and shall be part of •the moneys in the said Fund, and may be used and applied in and for any of the purposes for which moneys in the said Fund may be used and applied under the provisions of the principal Act.
