An Act to amend the Coal Mines Regulat ion
Act, 1896. [5th November, 1900.]
BE it enacted by the Queen 's Most Excellent Majesty, by and with
Assembly of New South Wales in Pa r l i amen t assembled, and by the the advice and consent of the Legislative Council and Legislat ive au thor i ty of the same, as follows:—
1 . This Act may be cited as the " Coal Mines Regulat ion Act
(Amendment) Act, 1900."
2. " Pr inc ipa l Act " means Coal Mines Regulation Act, 1896.
3. Rule for ty of the general rules contained in section forty-seven
of the Pr inc ipa l Act is hereby repealed, and the following rule is sub
st i tuted in i ts p lace:— Rule 40. No person other than a person employed or working a t the commencement of this Act as a coal-getter or shale-getter shall work or be allowed to work as a coal-getter or a shale- get ter in the face of the workings of a mine, unless—
(a) he has been employed or has worked for two years in or about the face of the workings of a mine as a coal-getter or shale-get ter ; or (b) he works in company with a person who has been employed or has worked for two yea r s in or about the face of the workings of a mine as a coal-getter or a shale-getter.
Where it is repor ted to an inspector and such inspector is satisfied after due inquiry tha t any person is working in any mine in contravention of the provisions of this rule, he may, after giving notice to the owner of the mine, or his agent, or manager , order such person to cease working, and such person shall thereupon cease working as aforesaid.

4. Where in consequence of any false representa t ion, and under the belief in good faith tha t such represenat ion is t rue , any boy is employed at an age a t which his employment is a contravention of the Pr incipal Act, or any person is allowed to work as a coal-getter or a shale-getter in the face of the workings of a mine in contravention of the provisions of the Pr inc ipa l Act as amended by this Act, the owner, agent, or manager of the mine and employer shall be exempted from any penalty for such contravention, and the person making the false repre sentat ion shall be deemed guil ty of an offence against the Pr inc ipa l Act.
5. The following general rule is hereby added to the rules in section forty-seven of the Pr incipal Act:—Rule 42.

exceeding one hundred and fifty feet in depth shall be provided with guides and guide a t tachments applied in such manner as to prevent the bucket or other appliance from swinging while being lowered or raised in such shaft, and such guides and guide a t tachments shall be maintained from the surface to a distance of not more than seventy-five feet from the bottom of such shaft until its sinking has been completed.
6. Subsection one of section sixty-two of the Principal Act is hereby amended by the omission of the word " three " and the insertion in lieu thereof of the word " s i x . "
7. Section sixty-four of the Principal Act is hereby repealed.
