COAL MINES, REGULATION ACT 1982—REGULATION

(Relating to suspension and cancellation of certificates of competency)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Coal Mines Regulation Act 1982, has been

pleased to make the Regulation set forth hereunder.

The Coal Mines Regulation (General-Forms) Regulation 1984 is

amended:

(a) by omitting from clause 1 the word "Forms";

(b) by inserting after clause 5 the following clause:

Suspension or cancellation of certificates of competency

6. (1) For the purposes of section 26 (1) of the Act, the prescribed period is 14 days (being the period within which notice must be given of intention to show cause why a certificate of competency should not be suspended or cancelled).

(2) For the purposes of section 26 (3) of the Act, the prescribed period is 90 days (being the period within which the Chief Inspector is to file with a court a statement in relation to a certificate of competency that is the subject of a show cause notice).

EXPLANATORY NOTE

The object of this Regulation is to amend the Coal Mines Regulation

(General-Forms) Regulation 1982:

1991—No. 145

(b) to prescribe 14 days as the period within which a person who is called upon to show cause why his or her certificate of competency should not be suspended or cancelled must give notice of intention to show cause; and
(c) to prescribe 90 days as the period within which the Chief Inspector is to file a statement with a court in relation to a certificate of competency that is the subject of such a show cause notice (for the purpose of enabling the court to make a recommendation to the Minister on the matter).
