COAL MINES REGULATION ACT 1982 - REGULATION
(Relating to approvals of equipment, apparatus,
materials, etc.)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Coal Mines Regulation Act 1982, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 August 1998.
Amendment of Coal Mines Regulation (Approval of Items)
Regulation 1984
2. The Coal Mines Regulation (Approval of Items) Regulation 1954 is amended:

by inserting in clause 5, in alphabetical order, the following "accredited assessing authority" means an assessing authority
the subject of an accreditation in force under clause 7A;
"assessing authority" means a person or body (whether within New South Wales or elsewhere) that, in the opinion of the Chief Inspector, has the expertise necessary to investigate and assess items;

(b) by inserting after clause 7 the following clause: Accredited assessing authorities
7A. (1) The Chief Inspector may, by notice published in the Gazette, accredit an assessing authority in relation to the approval of items for the purposes of this Regulation.
(2) An accreditation may be given:
(a) in respect of items generally or
(b) in respect of specified items or items belonging to a specified class of items. (3) The Chief Inspector may, by notice published in the Gazette, revoke, vary or amend an accreditation under this clause.
(4) An item that is approved by an assessing authority that is accredited in relation to that item is to be taken to be an approved item for the purposes of the Act and of any regulation under the Act
Amendment of Coal Mines Regulation (Belt Conveyor) Regulation
19843. The Coal Mines Regulation (Belt Conveyor) Regulation 1984 is amended by inserting in clause 5 (I), in alphabetical order, the following definition:
“approved” in relation to any equipment, apparatus, material or
thing, means approved:
(a) by the Chief Inspector; or
(b) by an accredited assessing authority,
under the Coal Mines Regulation (Approval of Items) Regulation
1984;
Amendment of Coal Mines Regulation (Electrical - Open Cut Mines)
Regulation I9844. The Coal Mines Regulation (Electrical - Open Cut Mines) Regulation 1984 is amended by inserting in clause 5 (1), in alphabetical or de r, the following definition:

thing, means approved:
(a) by the Chief Inspector; or
(b) by an accredited assessing authority,
under the Coal Mines Regulation (Approval of Items) Regulation
1984;

Mines) Regulation 1984
5. The Coal Mimes Regulation (Electrical - Underground Mines) Regulation 1984 is amended by inserting in clause 5 (1), in alphabetical order, the following definition:
“approved” in relation to any equipment, apparatus, material or
thing, means approved:
(a) by the Chief Inspector; or
(b) by an accredited assessing authority,
under the Coal Mines Regulation (Approval of Items) Regulation
1984;
Amendment of Coal Mines Regulation (Fire Control - Open Cut
Mines) Regulation 1984
The Coal Mines Regulation (Fire Control - Open Cut Mines)
Regulation 1984 is amended by inserting in clause 5, in alphabetical order, the following definition:
“approved” in relation to any equipment, apparatus, material or
thing, means approved:
(a) by the Chief Inspector; or
(b) by an accredited assessing authority,
under the Coal Mines Regulation (Approval of Items) Regulation
1984;

Mines) Regulation 1984
7. The Coal Mines Regulation (Fire Control - Underground Mines) Regulation 1984 is amended by inserting in clause 5, in alphabetical order, the following definition:

thing, means approved:
(a) by the Chief Inspector; or
(b) by an accredited assessing authority,
under the Coal Mines Regulation (Approval of Items) Regulation
1984;
Amendment of Coal Mines Regulation (Mechanical - Open Cut
Mines) Regulation 19848. The Coal Mines Regulation (Mechanical - Open Cut Mines) Regulation 1984 is amended by inserting in clause 5, in alphabetical order, the following definition:
“approved” in relation to any equipment, apparatus, material or
thing, means approved:
(a) by the Chief Inspector; or
(b) by an accredited assessing authority,
under the Coal Mines Regulation (Approval of Items) Regulation
1984;
Amendment of Coal Mines Regulation (Mechanical - Underground
Mines) Regulation 19849. The Coal Mines Regulation (Mechanical - Underground Mines) Regulation 1984 is amended by inserting in clause 5, in alphabetical order, the following definition:
“approved” in relation to any equipment, apparatus, material or
thing, means approved:
(a) by the Chief Inspector; or
(b) by an accredited assessing authority,
under the Coal Mines Regulation (Approval of Items) Regulation
1984;
Amendment of Coal Mines Regulation (Shafts and Roadways -
Underground Mines) Regulation 198410. The Coal Mines Regulation (Shafts and Roadways - Underground Mines) Regulation 1984 is amended by inserting in clause 5, in alphabetical order, the following definition:

(a) by the Chief Inspector; or

Amendment of Coal Mines Regulation (Transport - Underground
Mines) Regulation 1984
11. The Coal Mines Regulation (Transport - Underground Mines) Regulation 1984 is amended by inserting in clause 5, in alphabetical order, the following definition:
“approved” in relation to any equipment, apparatus, material or
thing, means approved:
(a) by the Chief Inspector; or (b) by an accredited assessing authority, under the Coal Mines Regulation (Approval of Items) Regulation
1984;
EXPLANATORY NOTE
The objects of this Regulation are:
(a) to amend the Coal Mines Regulation (Approval of Items) Regulation 1984 so as to enable the Chief Inspector to accredit certain assessing authorities
in relation to the approval of equipment, apparatus, materials and things for
the purposes of that Regulation; and
(b) to make consequential amendments to certain other regulations under the Coal Mines Regulation Act 1982 so as to provide that references in those regulations to approved equipment, apparatus, materials and things are to be read as including references to equipment, apparatus, materials and
things approved by accredited assessing authorities.
