Her Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Coal Mine Subsidence Compensation Act 2017.

Explanatory note
The objects of this Regulation are:
| (a) | to amend the Coal Mine Subsidence Compensation Act 2017 to continue for a further period of 3 months (ending on 30 September 2019) provisions of the repealed Mine Subsidence Compensation |
Act 1961 relating to certificates of compliance and certificates of compensation claims paid, and
| (b) | to amend the Coal Mine Subsidence Compensation Regulation 2017 to specify the contributions to the Coal Mine Subsidence Compensation Fund that may be levied by the Chief Executive of Subsidence Advisory NSW on proprietors of certain coal mines. |
This Regulation is made under the Coal Mine Subsidence Compensation Act 2017, including sections 33 and 51 (the general regulation-making power) and clause 1 (5) of Schedule 1.

1 Name of Regulation
This Regulation is the Coal Mine Subsidence Compensation Amendment
(Miscellaneous) Regulation 2019.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.

Omit “30 June 2019” wherever occurring in clause 14. Insert instead “30 September 2019”.

Omit the clause. Insert instead:
10 Contributions under section 33
(1) For the purposes of section 33 of the Act, the Chief Executive may, by notice in writing given to the proprietor of a coal mine specified in Column 1 of Schedule 2, levy the amount (if any) specified in Column 2 of that Schedule opposite that coal mine as a contribution payable to the Coal Mine Subsidence Compensation Fund. (2) A contribution levied by the Chief Executive is due and payable within 28
days of receipt of the notice referred to in subsection (1).(3) The Chief Executive:
(a) may only levy a contribution in accordance with this clause before 1 December 2019, and (b) must not levy more than 1 contribution in respect of a particular coal mine before that date.
