Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Coal Mine Health and Safety Act 2002.

Explanatory note
Clause 88 of the Coal Mine Health and Safety Regulation 2006 enables the Minister to approve a method of mining other than the bord and pillar system for use in an underground mine, subject to certain requirements. Clause 88 of the Regulation is due to expire on 1 September 2009.
The object of this Regulation is to amend the Coal Mine Health and Safety Regulation 2006:

(a) to omit that expiry date so that clause 88 has continued application, and
(b) to make consequential amendments to a savings provision.

This Regulation also makes amendments by way of statute law revision. sections 192 (the general regulation-making power) and 193 (cs).

1      Name of Regulation

This Regulation is the Coal Mine Health and Safety Amendment
(Underground) Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Coal Mine Health and Safety Regulation 2006

(1) Clause 88 Bord and pillar system to be used in underground mines

Omit “section” from clause 88 (3). Insert instead “clause”.

(2) Clause 88 (3) (b)
Omit “subsection”. Insert instead “subclause”.
(3) Clause 88 (6)
Omit the subclause.
(4) Schedule 2 Savings and transitional provisions
Omit “1 September 2009” wherever occurring in clause 20.
Insert instead “31 December 2010”.
