Coal Industry Superannuation Amendment

Regulations 2009

Made by the Governor in Executive Council.

1. Citation

These regulations are the Coal Industry Superannuation
Amendment Regulations 2009.

1. Commencement

   These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

1. Regulations amended

These regulations amend the Coal Industry Superannuation
Regulations 1990.

1. Regulation 3 amended

(1)	In regulation 3(1) delete the definition of partner.
(2)	In regulation 3(1) insert in alphabetical order:

Division,

dependant has the meaning given in the SIS Act
section 10(1);
partner means a spouse as defined in the SIS Act
section 10(1);

1. Regulation 9 deleted

   Delete regulation 9.

2. Regulation 23 amended

   In regulation 23 delete "Division and Division 3," and insert:

7.            Regulation 36 amended

Delete regulation 36(1) and insert:

(1) Subject to subregulation (2), pensions which become

payable under this Part shall be paid at the rate at
which they were paid or payable immediately before
the coming into operation of the Act.

8.            Regulations 37 and 38 deleted

Delete regulations 37 and 38.

9.            Regulation 42 amended

In regulation 42(2a) delete "spouse or de facto".
