193 ( fztslaz ANNO OCTODECIMO ELIZABETHAE SECUNDAE REGINAE No. 32 of 1969 An Act to Amend The Coal Industry (Control) Acts 1948 to 1965 i n a certain particular [ASSENTED TO 19TH DECEMBER, 1969] BE IT ENACTED by the Queen ' s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:- 1. Short title and citation . (1) This Act may be cited as the Coal Industry ( Control ) Act Amendment Act 1969. (2) The Coal Industry ( Control ) Act of 1948 as amended from time to time is in this Act referred to as the Principal Act. 2. Interpretation . ( 1) In this Act unless the contrary intention appears , words and expressions shall have the same meanings as in the Principal Act. (2) This Act shall be read as one with the Principal Act. 3. Declaration as to powers and functions of the Board . (1) It is hereby declared that the Board has, and at all times during which the Principal Act has been in force has had full power and authority to exercise and perform all or any of the powers and functions conferred upon the Board by the Principal Act with respect to all matters appertaining or incidental to the production, supply and distribution of coal for purposes of electricity generation at electricity generating stations in or which may hereafter be built in the Swanbank locality of 7
194 Coal Industry (Control) Act Amendment Act 1969, No. 32 the West Moreton Coalfield and elsewhere (other than the Swanbank A electricity generating station) free of all obligations, claims and interests of whatsoever kind that may exist at the commencement of the Coal Industry (Control) Act Amendment Act 1969 or that may thereafter arise out of anything existing at that commencement. (2) No action, suit, claim , demand, reference to or proceeding in arbitration shall be taken, made , had, commenced, instituted or carried on against the Crown, the Minister, the Board, or any member of the Board in relation to the exercise and performance by the Board of the powers and functions to which subsection (1) of this section relates. (3) In this section a reference to the Swanbank A electricity generating station is a reference to the electricity generating station constructed in the Swanbank locality for the Southern Electric Authority of Queensland that comprises six generating units each of sixty-six megawatts capacity, the first of which units was commissioned or placed in service in or about April, 1966 and the sixth or last of which units was commissioned or placed in service in or about February, 1969. (4) This section shall in no way limit, prejudice or affect the operation of the Principal Act apart from this section and the powers and functions conferred upon the Board shall continue in full force and effect with respect to all matters appertaining or incidental to the production, supply and distribution, of coal for purposes of electricity generation at the Swanbank A electricity generating station as if this section had not been passed.
