COAL INDUSTRY (AMENDMENT) ACT.

An Act relating to the tenure of office of Francis Heath Gallagher as the Coal Industry Tribunal and member of the Commonwealth Conciliation and Arbitration Commission; for this purpose to amend the Coal Industry Act, 1946, as amended by subsequent Acts; and for purposes connected therewith.

1. This Act may be cited as the " C o a l I n d u s t r y

(Amendment ) Act, 1957" .

2.     This Act shall commence upon a day to be appo in ted

by the Governor and notified by proclamat ion published

in the Gazette.

3. The Coal I n d u s t r y (Amendment ) Act, 1955, is

repealed.

4. F o r the purposes of section thir ty-s ix of the Coal

I n d u s t r y Act, 1946-1951—
(a) the holding by F r a n c i s H e a t h Gallagher, while

he is the person const i tu t ing the Coal I n d u s t r y Tr ibunal , of office as a member of the Common­ wealth Conciliation and Arb i t r a t i on Commis­ sion, and the engagement by him in the per fo rm­ ance of the dut ies and functions of t ha t office, shall be deemed not to be engagement by him in pa id employment outside the duties of his

office as the person const i tu t ing the Coal
I n d u s t r y T r i b u n a l ; and
(b) a day on which F r a n c i s Hea th Gal lagher

pe r fo rms duties or functions as a member of the Commonwealth Conciliation and Arb i t r a t ion Commission shall be deemed not to be a day on which he absents himself from du ty as the person

const i tu t ing the Coal I n d u s t r y Tr ibuna l .
