Act No. 84, 1980.

An Act to amend the Coal and Oil Shale Mine Workers (Superannuation) Act, 1941, with respect to the entitlement of widows to lump sum payments under that Act; and for other purposes. [Assented to, 1st May, 1980.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1.      This Act may be cited as the "Coal and Oil Shale Mine

Workers (Superannuation) Amendment Act, 1980".

2 .       (1) Except as provided in subsection ( 2 ) , this Act shall

commence on the date of assent to this Act.

(2) If the date of assent to this Act is on or after 6th April, 1980, sections 3 (a) and 4 shall be deemed to have commenced on the date of assent.

3.      The Coal and Oil Shale Mine Workers (Superannuation)

Act, 1941, is amended—

(a) by inserting in section 3A (1) (c) (ii) after the word "retirement" the words "or the date of death of the mine worker, whichever first occurs";

(b) (i) by omitting from section 32 (7) (c) the matter "1st February, 1980" and by inserting instead the matter "30th January, 1981";

(ii)   by omitting from section 32 (7) (d) the matter "6th April, 1980" and by inserting instead the matter "19th April, 1981".

4 . All regulat ions m a d e pur suan t t o section 32 ( 5 ) of the Coal

and Oil Shale M i n e Worker s ( S u p e r a n n u a t i o n ) Ac t , 1 9 4 1 , and in force immedia te ly before the date of assent to this Act , shall, on that da te , be revoked.
