COAL AND OIL SHALE MINE WORKERS
(PENSIONS) AMENDMENT ACT.
Act No. 14, 1947.
An Act to increase the rates of pensions payable under the Coal and Oil Shale Mine Workers (Pensions) Act, 1941-1942; to make further provisions as to the granting of such pensions and the contributions to the Funds estab- lished under the said Act; for these and other purposes to amend the said Act in certain respects ; to validate certain matters ; and for purposes connected therewith. 1 . (1) This Act may be cited as the "Coal and Oil Shale Mine Workers (Pensions) Amendment Act. 1947." lative Council and Legislative Assembly of New South BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis-

(2) The Coal and Oil Shale Mine W o r k e r s (Pen
sions) Act, 1941, as amended by subsequent Acts and by this Act, may be cited as the Coal and Oil Shale Mine

2. (1) The Coal and Oil Shale Mine Worke r s (Pen
sions) Act, 1941-1942, is amended:—
(a) by inserting at the end of section six the follow ing new subsection:— (4) (a) The amount of pension per week pay able to any mine worker who has , before the twenty-ninth day of June , one thousand nine hundred and forty-seven, been awarded a pension pu r suan t to subsection one, two or three of this section, shall as from such date and not wi ths tand ing anyth ing contained in this section be two pounds five shillings.
(b) The amount of pension per week payable to any mine worker who on or af ter the twenty-ninth day of June , one thousand nine hundred and forty-seven becomes eligible for a pension pu r suan t to subsection one, two or th ree of this section, shall as from the da te of re t i re ment and notwi ths tanding any th ing contained in this section be two pounds five shillings.
(b) by omitting from subsection one of section seven
the words " t w o p o u n d s " and by inser t ing in
lieu thereof the words " t w o pounds five sh i l l i ngs ' ' ;
(c) (i) by inser t ing in subsection one of section eight af ter the word " p e n s i o n " where firstly occurr ing the words " o f two pounds
five shillings per w e e k " ; (ii) by omitting subsection two of the same section;
(d) (i) by omitt ing from p a r a g r a p h (a) of sub section one of section nine the words " a n amount of one pound pe r week in respect of his wife, or, where his wife is in receipt of or is eligible for an invalid or old age
pension,
pension, an amount of one pound five sh i l l i ngs" and by inser t ing in lieu thereof the words " a n amount of one pound ten sh i l l i ngs ' ' ;
(ii) by omit t ing from p a r a g r a p h (c) of the same subsection the words " o n e p o u n d " and by inser t ing in lieu thereof the words " o n e
pound ten sh i l l i ngs" ; (iii) by omitting from subsection five of the same section the words " o n e pound pe r week in respect of such female, or, where such female is in receipt of or is eligible for an old age pension, an amount of one pound five sh i l l i ngs" and by inser t ing in lieu there
of the words " o n e pound ten sh i l l i ngs " ;
(e)
by omitting from section ten the words "one pound ten sh i l l i ngs" wherever occurr ing and by inser t ing in lieu thereof the words " o n e pound
fifteen sh i l l ings" .
(2) The amendments made by p a r a g r a p h s (b) , (c)
and (d) of subsection one of this section shall commence upon the twenty-ninth day of June , one thousand nine hundred and forty-seven, and shall be deemed to extend to and from such date apply in respect of all mine workers who were immediately before such date in receipt of a pension p u r s u a n t to section six, seven, or eight or an addit ion to a pension p u r s u a n t to section nine of the Coal and Oil Shale Mine Worke r s (Pensions)
Act, 1941-1942, as well as to mine workers becoming eligible for any such pension or addi t ion there to af ter such date .
(3) The amendments made by p a r a g r a p h (e) of subsection one of this section shall commence upon the twenty-ninth day of J u n e , one thousand nine hundred and forty-seven, and shall be deemed to extend to and from such date app ly in respect of all persons who were immediately before such date in receipt of a pension p u r s u a n t to section ten of the Coal and Oil Shale Mine W o r k e r s (Pensions) Act, 1941-1942, as well as to persons becoming eligible for any such pension af ter such date .
3. (1) The Coal and Oil Shale Mine W o r k e r s (Pen
sions) Act, 1941-1942, is fur ther amended:—
(a) by omitting from subsection two of section fifteen the word " w h o " and by inser t ing in lieu thereof the words " e a c h of whom other than the C h a i r m a n " ; (b)
by omit t ing p a r a g r a p h (a) of subsection three of the same section;
(c) by inserting next after the same subsection the following new subsection:— (3A) The Cha i rman of the Jo in t Coal Board consti tuted pu r suan t to the Coal I ndus t ry Act, 1946, shall be a member of the Tr ibunal and shall be the Cha i rman thereof.
(d) by omit t ing p a r a g r a p h (a) of subsection eight of the same section.
(2) Subsection one of this section shall commence upon the first day of Apr i l , one thousand nine hundred and forty-seven.
4. (1) The Coal and Oil Shale Mine Worke r s (Pen
sions) Act, 1941-1942, is fur ther amended:—
(a) by omit t ing from subpa rag raph (i) of pa ra g r a p h (b) of subsection three of section nineteen the words "one - th i rd p a r t " and by inser t ing in lieu thereof the words " two-seven th p a r t s " ;
(b) by omitting from subparagraph (ii) of the same
p a r a g r a p h the words " two- th i rd p a r t s " and by
inser t ing in lieu thereof the words "five-
seventh p a r t s " .
(2) Subsection one of this section shall commence upon the first day of Ju ly , one thousand nine hundred and forty-seven.
5 . The action of the Pensions Tribunal in awarding and paying, as an addition to the pension of a mine worker in respect of his wife or a female dependant, an amount of one pound five shillings per week when such wife or female dependant was not in receipt of or eligible for an invalid or old age pension, is hereby validated.
