7 ANNO VICESIMO QUARTO ELIZABETHAE SECUNDAE REGINAE No. 4 of 1975 An Act to amend the Coal and Oil Shale Mine Workers (Pensions ) Act 1941-1973 in certain particulars [ASSENTED To 18TH APRIL, 1975] BE IT ENACTED by the Queen's Most Excellent Majesty,. by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:- 1. Short title and citation . (1) This Act may be cited as the Coal and Oil Shale Mine Workers (Pensions) Act Amendment Act 1975. (2) The Coal and Oil Shale Mine Workers (Pensions) Act 1941-1973 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Coal and Oil Shale Mine Workers (Pensions) Act 1941-1975. 2. Commencement . (1) Subject to subsections (2) and (3), this Act shall come into operation on the day on which it is assented to for and on behalf of the Crown.
8 Coal and Oil Shale , Etc. (Pensions ) Act Amdt Act 1975, No. 4 (2) Sections 3 and 4 shall be deemed to have come into operation on 2 January 1975 and to the extent necessary to give effect to this sub- section this Act shall operate retrospectively accordingly. (3) Section 5 shall come into operation on the Monday next following the day on which this Act is assented to for and on behalf of the Crown. 3. Amendment of s. 10B . Section 10B of the Principal Act is amended by- (a) omitting subsection (9) and substituting the following sub- section:- ,, (9) When and so often as the rate of age pension payable under the Social Services Act1947-1974 of the Commonwealth (or any Act amending or substituted for that Act) is increased, the amounts specified in the second column of the Table to this section, save the amount set out in that column opposite and relevant to the word " child", shall be increased, or further in- creased as the case requires, by the addition thereto of a sum equal to- ( a) in the case of a single pensioner or widower or widow, the increase in the maximum weekly rate of the said age pension payable to a single pensioner; (b) in the case of a married man or man and housekeeper the combined increase in the - maximum weekly rates of the said age pension payable to a married pensioner and wife, and for the purposes of determining the first such increase the weekly rate of age pension as on the date on which section 3 of the Coal and Oil Shale Mine Workers ( Pensions ) Act Amendment Act 1975 is deemed to come into operation shall be in the case of a single pensioner $31, and in the case of a married pensioner and wife $51.50.". (b) omitting the table at the end of the section and substituting the following table:- " TABLE First Column Class of Pensioner Second Column Third Column per week per week Single or widower Married Man Man and Housekeeper Widow Child .. .. $39 $61.50 $61.50 $36.25 $2.50 $8 $10 $10 S5.25 f, 4. Amendment of s . 10C. Section IOC of the Principal Act is amended by- (a) omitting from subsections (1), (2) and (3) the expression " $27" wherever it occurs and substituting - in each case the expression " $35"; . (b) omitting from subsection (4) the words " twenty-seven dollars" and substituting the expression " $35";
Coal and Oil Shale, Etc. (Pensions ) Act Amdt Act 1975, No. 4 9 (c) omitting from subsection (7) the expression "$ 4 860" where it twice occurs and substituting in each case the expression " $6 300". 5. Amendmen t of s. 18. Section 18 of the Principal Act is amended by, in subsection ( 1), omitting the first paragraph and substituting the following paragraph:- " The contributions to the Fund and for a reserve in connexion with the Fund shall be paid by the following persons in the pro- portions specified- (a) the Treasurer -$ 150 000 for the year commencing on 1 July 1975 and for each succeeding year; (b) each mine worker-$1.40 per week or such other amount as may be specified by the Actuary appointed pursuant to section 26 of this Act; (c) each owner-in respect of each mine worker employed by him, $6.30 per week or where the Actuary specifies another amount with respect to a mine worker, four and one - half times that amount per week.".
