(Extending the time within which claims for compensation may be made)

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of of section 6 of the Coal Acquisition Act 1981 and clause 33 of the Coal Acquisition (Compensation) Arrangements 1985, and of all other powers enabling me in that behalf, make the arrangements set out in this instrument.

The Coal Acquisition (Compensation) Arrangements 1985 are

amended:

(a) by inserting after clause 10 (4) the following subclause:

(5) Notwithstanding subclause (l), the Compensation Board may entertain a claim for compensation lodged after 29 June 1994 by a person referred to in that subclause, but only if the claim was lodged with the Compensation Board on or before 7 July 1994 and otherwise complies with this clause.

(b) by inserting after clause 11 (2) the following subclause:

(3) Notwithstanding subclause (l), the Compensation Board may entertain a claim for compensation lodged after 29 June 1994 by a person referred to in that subclause, but only if the claim was lodged with the Compensation Board on or before 7 July 1994 and otherwise complies with this clause.

(c) by inserting after clause 12 (2) the following subclause:

(3) Notwithstanding subclause (l), the Compensation Board may entertain a claim for compensation lodged after 29 June 1994 by a person referred to in that subclause, but only if the claim was lodged with the Compensation Board on or before 7 July 1994 and otherwise complies with this clause.

EXPLANATORY NOTE

The object of this instrument is to enable the New South Wales Coal Compensation Board to deal with claims for coal compensation lodged out of time provided the claims were lodged on or before 7 July 1994.
