(Corresponding Co-operatives Law)
Regulations 2017

under the

Co-operatives National Law

His Excellency the Lieutenant-Governor of New South Wales, with the advice of the Executive
Council and on the recommendation of the Ministerial Council, and as designated authority under
section 612 of the Co-operatives National Law, has made the following Regulations under the

Co-operatives National Law.

Explanatory note

The objects of these Regulations are as follows:

(a) New regulation 1.6 is inserted to make a declaration that results in the Co-operatives Act 2009 (as

amended) of Western Australia, together with the regulations under that Act, becoming a

corresponding co-operatives law for the purposes of the Co-operatives National Law. Western

Australia then becomes a participating jurisdiction for the purposes of the national co-operatives scheme.

(b)

Regulation 3.10 is amended to remove words that are not relevant to income and expenditure statements of a co-operative.

1      Citation

These Regulations may be cited as the Co-operatives National Amendment
(Corresponding Co-operatives Law) Regulations 2017.

2      Commencement

These Regulations are required to be published on the NSW legislation website and commence on the day on which they are so published.

3 Amendment of Co-operatives National Regulations

(1) Regulation 1.6

Insert after regulation 1.5:

1.6 Declaration of corresponding co-operatives law (section 7(3))
(1) In this regulation, WA co-operatives legislation means the

Co-operatives Act 2009 of Western Australia and the Co-operatives

Regulations 2010 of Western Australia.

(2)

For the purposes of section 7(3) of the Co-operatives National Law, the WA co-operatives legislation is declared to be a law that substantially corresponds to the provisions of the Co-operatives National Law.

(2) Regulation 3.10 Small co-operative—reports where no members’ direction
(section 270(3))
Omit “and the assets and liabilities of the co-operative” from regulation 3.10(2)(a).
