AN ORDINANCE

To amend the Co-operative Societies Ordinance 1939-1973.

the Seat of Government (Administration) Act 1910-1973.

CO-OPERATIVE SOCIETIES ORDINANCE 1974

1. (1) This Ordinance may be cited as the Co-operative Societies

Ordinance 1974.*

(2) The Co-operative Societies Ordinance 1939-1973f is in this

Ordinance referred to as the Principal Ordinance.

(3) The Principal Ordinance, as amended by this Ordinance, may

be cited as the Co-operative Societies Ordinance 1939-1974.

2 . Section 3 of the Principal Ordinance is repealed.

3. Section 4 of the Principal Ordinance is amended by inserting,

after the definition of "credit society", the following definition:—

" ' housing and services society' means a society formed in

pursuance of section 14J ; " .

4 . The Principal Ordinance is amended by inserting after Part IIIB

the following Par t :—

" PART IIIC—CO-OPERATIVE HOUSING AND SERVICES SOCIETIES.

" 14J. A housing and services society may be formed for all or any

of the following objects:—

(a)

to acquire land on which to erect a building or buildings suitable for residential purposes, or on which such a build­ ing has been or is being erected, and to dispose of or lease that land or let part of such a building;

(b)

to erect on a member's land, or to erect on its own land for sale or letting, buildings suitable for residential pur­ poses;

(c)

to provide services in respect of land acquired by the society; and

(d)

to provide and maintain on land acquired by the society buildings and grounds for any purpose incidental to the use of that land for residential purposes.".

5 . Section 16 of the Principal Ordinance is amended by inserting

after sub-section (7A) the following sub-section:—

" (7B ) The Registrar shall not register a society if he is of the

opinion that—

(a) the proposed society has no reasonable prospects of carry­ ing out its objects successfully; or
(b) the proposed society is not designed or intended to serve equitably the interests of its members and prospective members.".
