Co-operative Housing Societies Amendment Act 1998

An Act to amend the Co-operative Housing Societies Act 1963

[Royal Assent 22 May 1998]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Co-operative Housing Societies Amendment Act 1998 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Co-operative Housing Societies Act 1963 is referred to as the Principal Act. 4Section 3 amended (Registrar and other officers) Section 3 of the Principal Act is amended by inserting after subsection (2) the following subsections: (3)  The Registrar may have a seal of office approved by the Minister. (4)  The Deputy Registrar may perform the functions and exercise the powers of the Registrar under this Act. (5)  All acts, matters and things done or omitted to be done by the Deputy Registrar in the exercise of any function or power pursuant to subsection (4) is as valid and effectual as if they had been done or omitted to be done by the Registrar. 5Section 82A insertedBefore section 83 of the Principal Act , the following section is inserted in Division 3: 82ALiability of directors of TOFS (1)  A director of the board of directors of TOFS incurs no liability for an honest act or omission in the performance or purported performance of functions, or exercise or purported exercise of powers, under this Act. (2)  A liability that would, but for this section, attach to a director attaches to TOFS. (3)  This section does not apply to – (a) wilful misconduct; or (b) wilful neglect; or (c) wilful failure to comply with this Act.
