513 f^ttepnslttn^ ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE No. 52 of 1976 An Act to amend the Co-operative and Other Societies Act 1967-1974 in certain particulars and for another purpose [ASSENTED TO 1ST OCTOBER, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Co-operative and Other Societies Act Amendment Act 1976. (2) The Co-operative and Other Societies Act 1967-1974 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Co-operative and Other Societies Act 1967-1976.

Section 102 of the Principal Act is amended by omitting subsection (7) and substituting the following subsection:- (7) (a) The Registrar may appoint- (i) an inspector appointed, or an inspector ex officio, pursuant to section 7 (2); or (ii) any other person to be an inspector, to hold any such inquiry. (b) The provisions of the Public Service Act1922-1973 are not applicable to a person appointed to be an inspector pursuant to this subsection who is not an officer of the Public Service of Queensland.". 3. Amendment of s. 103. Section 103 of the Principal Act is amended by omitting subsection (1) and substituting the following subsection:- " (1) (a) The Registrar may without any application hold an inquiry or appoint- (i) an inspector appointed, or an inspector ex officio, pursuant to section 7 (2); or (ii) any other person to be an inspector, to hold an inquiry into the affairs of any society. (b) The provisions of the Public Service Act1922-1973 are not applicable to a person appointed to be an inspector pursuant to this subsection who is not an officer of the Public Service of Queensland.". 4. Amendment of s. 104 . Section 104 of the Principal Act is amended by inserting, after the words " inspector concerned ", the words "(including a person appointed by the Registrar to be an inspector pursuant to section 102 or section 103)". 5. Amendment of s. 117. Section 117 of the Principal Act is amended by inserting after paragraph (c) the following paragraph:- .. (d) any person appointed under this Act to make an inspection or hold an inquiry,".

Any thing done prior to the commencement of this Act which purports to have been done under the authority of the Principal Act, notwithstanding any defect in, or the absence of any authority for, the doing thereof or the manner in which such thing was done, and which would be authorized by the Principal Act as amended by this Act had it been done after such commencement, shall be deemed to have been authorized by the Principal Act.
