B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Oouncil and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1 (1.) In the title of "The Co-operative Agricultural Am~ ndment Production Act of1914," *herein referred to as the Principal of tItle. Act, after the word "Agriculture" the words "and to provide for Advances to Farmers" are inserted. (2.) In section one of the Principal Act, "after the ~ me~ dment word "Production" the words " and Advances to 0 s. . Farmers'" are inserted. (3.) The Principal Act and this Act may together be cited as "The Oo-operative Agricultural Production and Advances to Farmers Acts, 1914 to 1919." Amendment 2. In section two of the Principal Act, before the de- of s. 2. finition of "Land" the following definitions are inserted:- Dairy tarmer. "Dairy farmer "-A person engaged in dairying who is the owner of not more than twenty cows, the produce of which is sold to a factory for the manufacture of butter, cheese, or con- densed milk; or a person desiring to engage in dairying who wishes to purchase not more than twenty-five female dairy cattle the produce of which is to be sold as aforesaid; "Farmer"-A person who annually cultivates not less than ten acres of land, and plants that area. The following provision is added to the said definition of " Land" :- "Where by this Act any remedy is given to the lY.Iinister against or with respect to any land, the term "Land" includes not only the land but also all improvements thereon." After the definition of "Regulations" the following definition is inserted:- Sheep .fa.rmer. "Sheep farmer "-A person engaged in sheep farming who is the owner of not more than two hundred sheep; or a person desiring to engage in sheep farming who wishes to pur- chase not more than two hundred sheep; Amendment 3. In paragraph (ii.) of subsection three of section of s. 3. three of the Principal Act, the words "the majority in" are repealed and the words "two thirds at least of the" are inserted in lieu thereof; also, the words" four pounds" are repealed and the words " six pounds" are inserted in lieu thereof. In the first paragraph of section eight of the Amendmen~ Principal Act, after the word "made" the words "toa of s. 8. company" are inserted. The following paragraph is inserted in the said section after the said first paragraph thereof ;-- "No advance shall be made to a .dairy farmer, farmer, or sheep farmer, under this Act except upon such security as to the Minister may seem fit or as may be prescribed." The following provision is added to the said section;- "The provisions of "The Mercantile Acts, 1867 to 1896," requiring the registmtion of mortgages of live stock shall not apply to any mortgage of live stock executed in favour of the Minister under this Act." 6. In subsection one of section nine of the Principal Amendment Act, the words "four pounds" are repealed and the of s. 9. words" five pounds P are inserted in lieu thereof. In subsection two of the said section, the words " nine pounds nine shillings and four pence" are repealed and the words "ten pounds two shillings and one penny" are inserted in lieu thereof. 7. After section eleven of the Principal Act, the following sections are inserted bearing the numbers herein set against them respectively in square brackets; and sections 12, 13, 14, and 15 of the Principal Act shall be renumbered 15, 16, 17, and 18 accordingly ; - [12.] The Min~ ster may, upon the application of any Advances to dairy farmer, farmer, or sheep farmer, make advances to fairy d the applicant for any of the objects mentioned in the first f: ~ : ~ : . an column of the table hereunder set forth, to an amount not exceeding the maximum amounts respectively mentioned in the second column thereof, and for a period to be fixed by the Minister not exceeding the maximum periods of time respectively limited in the third column thereof, that is to say;- Objects. The Governor in Council may from time to time, by Order in Council, add to this table by including other objects therein, and fixing the maximum amount of advance for each such object, and limiting the maximum period of time within which each such advance shall be repayable; and the table in force for the time being as so added to shall be deemed to be the table referred to in this provision. Every such advance shall be subject to such further conditions and stipulations as to the Minister may seem fit or as may be prescribed. Advance to [13.] (1.) The amount of an advance to a dairy farmer, ~ a~ er tO d farmer, or sheep farmer under this Act shall be deemed to lo~ n~eme a be a loan by the Minister to him for the period fixed by the Minister from the first day of July next succeeding the date of the advance, and shall bear interest at the rate of five pounds per centum per annum. Repayment (2.) The amount of such advance, with interest as of advance. aforesaid, shall be liquidated by the payment by the borrower to the Minister, on the first day of July in every year, of such sum as will permit of the repayment of the whole advance, together with interest as aforesaid, within the said period, and every such sum shall continue to be payable until the said amount, with interest accruing thereon, has been so paid. Acceleration (3.) Notwithstanding anything in this Act contained, of payments the Minister may from time to time permit the borrower of loan. to payoff the whole or any portion of the moneys advanced at any time before they are due. Saving of 7 Geo. V. No. 17. [14.] Nothing in this Act contained relating to advances to dairy farmers, farmers, or sheep farmers shall be construed to affect in any way the provisions of "The Queensland Government Savings Bank Act of 1916 ,,* or the powers of the Commissioner of the said Bank to make advances under the provisions of that Act or any other Act. And the fact, if it be so, that any dairy farmer, farmer, or sheep farmer is a borrower from the said Bank shall not of itself preclude him from obtaining an advance from the Minister under this Act.
