CLOSER SETTLEMENT VALIDATION ACT.

Act No. 8, 1948.

An Act to validate the vesting of certain land in the Crown for the purposes of closer settlement under the Closer Settlement Acts; and for purposes connected therewith. [Assented to, 29th April, 1948.]

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis-

Wales in Parliament assembled, and by the authority of the same, as follows :—

1 . This Act may be cited as the "Closer Settlement

Validation Act, 1948." 2 .

2. (1) The notification published in the Gazette, No. 137, of the 28th day of November, one thousand nine hundred and forty-seven, a t page 2791, p u r p o r t i n g to have been made p u r s u a n t to subsection three of section t en of the Closer Set t lement (Amendment) Act, 1919, as amended by subsequent Acts , shall have force and effect as if the agreement made on the four teenth day of April , one thousand nine hundred and forty-eight , between P a t J o h n B r y a n Osborne, El lendon Limited, Gran tham P a r k Limi ted and Lakelands (Bungendore) Limited, and the Governor and the Secre ta ry for Lands had been so made before the da te upon which such notification was so published.

(2) Such notification shall be and shall be deemed a lways to have been effective to vest the land described in the Schedule there to in His Majes ty for the purposes of the Closer Set t lement Acts and to the in tent t ha t such land may be deal t with t he reunde r ; and the ves t ing shall be deemed to have been effected as from the da te of publication of such notification.

(3) A n y action p u r p o r t i n g to have been taken af ter

the date of publication of such notification and before the commencement of this Act under the Closer Set t le­ ment Acts, the W a r Service L a n d Set t lement Act, 1941, a s amended by subsequent Acts, and any other Act, in respect of the land so vested shall have the like force and effect as if such land had vested as aforesaid as from the da te of publication of such notification.

(4) Nothing in this Act shall r ender unlawful any­
th ing done by the par t i es to the said agreement or any of

them or by any other person before the commencement

of this Act which would have been lawful if this Act had

not been enacted.
