Act. This Act may be cited with the Principal Act as "The Closer Settlement Acts, lU06-HH3," or separately as " The Olosm' Settlement Act Amendment Act of 1913." Term of lease 2. (1.) In the case of land selectea under the Principal extended. Act. after the passing of this Act the term of the lease shall be forty years instead of twenty-five years as provided by section thirty-two of' the Principal Act. Amendment (2.) Subsection three of the said section shall not apply of s. 32 (3). to any such selection, but the following provision shall apply to every such selection :-. " If the selection is forfeited before the eighth year of the term, the Crown shall be entitled to have recourse against any improvements upon the selection for the amount of interest at the rate of five pounds per centum per annurp on the purchasing price from ~he commence- ment of the term to the date of forfeIture, less any payments made by the selector for rent of the selection." Modification (3.) In the case of land selected under the Principal ofterms t of Act, after the passing of this Act the First Schedule to this ~ ; ~ : : ~ ~ l; e 1.J Act shall apply instead of the Schedule to tlle Principal - Act; and section thirty-three of the Principal Act shall be read and construed accordingly. Amendment (4.) The following words are added to the third. of s. 33. paragraph of section thirty-three of the Principal Act, and the said section shall be read and construed as if the. said words were inserted therein at the date of the passing of the Principal Act, namely :-" with interest added at the rate of five pounds per centum per annum from the first day of April next preceding the date of purchase if the purchase is not made on that day." • 6 Edw. Lanc1s Purchase AIcts'" Por t le"rmClpaI Act, saunrdrefnresehre or who: h~ ving taken adyantage of section thirty-five of ~ : ~ : ~ ~ d~ o: the Prmclpal Act, has been granted a fresh lease under term issued. that Act, may surrender his lease; whereupon he shall be [SeheduleII.] entitled to a fresh lease of the land for a term.which with the expired Jlortion of the original term shall be equal to forty years as se~ forth in the Second Schedule to this Act, and at an annual rent in accordance with the said Schedule; and such lease shall be deemed to have been g' ~ anted under" The Closer Settlement Acts, 1906-1913."t The amount to be paid by such lessee upon acquiring the fee-simple of such selection at any time before the expiration 'Of the term of the new lease shall be a sum equal to the amount then remaining unpaid in respect of the principal of the purchasing price, which sum shall be fixed by the lIinister. 4. Notwithstanding anything contained in the Prin- Sale~ by. cipal Act, any land which has been surveyed apd set apart ~ ~ : : ~ f: ::ses. for disposal as town allotments, or which is of insufficient area for opening for selection as an agricultural farm, or which has remained open for selection for not less than two years, may be sold by public auction under Part V. of " ~ Phe Land Act uf 1910,"t and the proceeds of all such sales shall be placed to the credit of the Special rfrust Account provided for in section seven of the Principal Act: .Provided that in the case of land that has been declared open for selection the upset price at auction shall not be fixed at less than the purchasing price at which the land could be selected as an Agricultural Farm. 5. (1.) Kotwithstanding anything to the contrary Relief to contained in the Principal Act, any lessee of a selection ~ ~ ee~ ~ ~ : nt in under the Agricultural Lands Purchase Acts* or the arrears. Such notice of approval shall operate as a waiver of forfeiture with respect to every such lease, but so far only as the non-payment of rent is concerned. (3.) ~ o sum by way of penalty shall be added to the rent in arrear or be payable by the lessee, but the amount of rent in arrear shall bear simple interest at the rate of five pounds per centum per annum from the thirty-first day of March in the year when the same became payable until the thirty-first day of March, one thousand nine hundred and eighteen (or if such rent is sooner paid then until the date of payment), and such interest shall be added to and be deemed to he part of the rent in arrear. (4.) The total amount of rent in arrear, inclusive of interest as aforesaid, is hereinafter referred to as "the rent in arrear," and shall be payable as follows:- (5.) If at the passing of this Act the rent was in arrear in respect of one year only, the same shall be paid in five yearly instalments at the rate of twenty-three pounds two shillings per annum for everyone hundred pounds of the rent in arrear. (6.) If at the passing of this Act the rent was in arrear in respect of two years but not more, the same shall be paid in ten yearly instalments at the rate of twelve pO'lmds nineteen shillings per annum for everyone hundred pounds of the rent in arrear. ' (7.) at the passing of this Act the rent was in al'rear in respect of three years but not more, the same shall be paid in fifteen yearly instalments at the rate of nine pounds twelve shillings and eight pence per annum for everyone hundred pounds of the rent in arrear. (8.) If at the passing of this A.ct the rent was in arrear in respect of four years or more, the same shall be paid in twenty yearly instalments at the rate of eight pounds and six pence for every one 'hundred pounds of the rent in arrear. (9.) In each of the above cases the first yearly instalment of the rent in 'arrear shall be payable not later than the thirty-first day of March, one thousand nine hundred and nineteen. (10.) If default is made by the lessee in the payment of any instalment of the rent in arrear, the same conse- quences shall ensue as upon a default made by him in the payment of rent under the Principal Act..
