Clean Waters Act Amendment Act 1981, No. 10 39 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Clean Waters Act Amendment Act 1981. (2) The Clean Waters Act 1971-1979 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the CleanWaters Act1971-1981. 2. Amendment of s. 8. Interpretation . Section 8 of the Principal Act is amended by- (a) omitting the definition of " Chief Engineer, Department of Local Government "; and (b) omitting the definition of " Minister " and substituting the following definition- " Minister " means the Minister of the Crown who at the material time is charged with the administration of this Act and includes any person who is temporarily performing the duties of the Minister;". 3. Amendment of s. 12. Membership of Council . Section 12 of the Principal Act is amended by in subsection (I)- (a) omitting paragraph (a) and substituting the following paragraph- (a) the Commissioner of Water Resources or his nominee, who shall be, ex officio, chairman;"; and (b) omitting subparagraph (i) of paragraph (c) and substituting the following subparagraph- (i) Local Government;"; and (c) inserting after subsection (1) the following subsection- (1A) A nominee of the Commissioner of Water Resources shall be an officer of the department administered by the Commissioner and may continue as such nominee only so long as he continues to be an officer of that department.".
