117 ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE No. 14 of 1976 An Act to amend the Clean Air Act 1963-1972 in certain particulars [ASSENTED TO 15TH APRIL, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short, title and citation . (1) This Act may be cited as the Clean Air Act Amendment Act 1976. (2) In this Act the Clean Air Act 1963-1972 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Clean Air Act 1963-1976. ' 2. Amendment of s. 22. Section 22 of the Principal Act is amended by omitting the words " two hundred pounds " and substituting the expression " $1 000 ".

Section 23 of the Principal Act is amended by omitting the words '° five hundred pounds " wherever occurring and substituting in each case the expression " S4 000 ". 4. Amendment of s. 35. Section 35 of the Principal Act is amended by omitting the words " two hundred pounds " and substituting the expression " S 1 000 ". 5. Amendment of s. 42. Section 42 of the Principal Act is amended by omitting the words " two hundred pounds " and substituting the expression " S 1 000 ". 6. Amendment of s. 45. Section 45 of the Principal Act is amended by omitting the words " two hundred pounds " and substituting the expression " S 1 000 ". 7. Amendment of s. 46. Section 46 of the Principal Act is amended by- (a) inserting after subsection (3) the following subsection:- (3A) Special Penalties in certain cases. Any person who- (a) is guilty of an offence under section 18, 26, 27, 28, 31 or 32 or that consists of a contravention or failure to comply with a condition attached to a license under section 19 or a prohibition ordered under section 36 or a direction ordered under section 37; or (b) is guilty of an offence against this Act by contravening or failing to comply with the standards prescribed in respect of the emission of air impurities from any premises, is liable to a penalty as follows:- Penalty for a first such offence: SIO 000 and, if the offence is a continuing one, a further penalty of $1000 for each day during which the offence continues. Penalty for a second or subsequent such offence: $20 000 and, if the offence is a continuing one, a further penalty of S2 000 for each day during which the offence continues, or imprisonment for twelve months or both such penalty and imprisonment."; (b) omitting from subsection (4) the words " two hundred pounds " and the words " fifteen pounds " and substituting the expression " S 1 000 " and the expression " $100 " respectively. 8. Amendment of s. 48 . Section 48 of the Principal Act is amended by omitting the words " fifty pounds " and substituting the expression " $250 ".

Section 50 of the Principal Act is amended by, in subsection (1), omitting from paragraph (xiv) the words " one hundred pounds " and the words " ten pounds " and substituting the expression " S500 " and the expression '` S50 " respectively.
