1Citation[see Note 1]

 These Regulations may be cited as the Classification (Publications, Films and Computer Games) Regulations.

2Commencement [see Note 1]

These Regulations commence on the commencement of the provisions, other than sections 1 and 2, of the Act.

3Interpretation

 In these Regulations, unless the contrary intention appears:

Act means the Classification (Publications, Films and Computer Games) Act 1995.

interactive or click-on access film,means a film referred to in subsection 14 (4) of the Act.

revised version, in relation to a film, means a film that has been classified and is subsequently modified, other than by changing the title of the film, by the addition, deletion or alteration of audio or visual content in the film.

running time, in relation to a film, means the audio or visual content of a film measured in elapsed time from the first sound or image to the final sound or image.

State or Territory includes an authority of a State or Territory.

title change means a film that has been classified and is subsequently modified by the replacement of the title under which the film was classified with another title.

trailer means an audio-visual recording advertising a film or a computer game that contains selected extracts or images from the film or computer game that is being advertised.

4Fee for classification of a publication

 For the purposes of subparagraph 13 (1) (d) (i) of the Act and subject to regulation 12, the fee for a category of publication specified in an item in column 2 in Part 1 of Schedule 1 is the amount prescribed in column 3 of the item.

5Fee for classification of a film

  • (1)

    For the purposes of subparagraph 14 (1) (d) (i) of the Act and subject to regulation 12, the fee for a category of film for public exhibition (other than a film mentioned in subregulation (4)) specified in an item in column 2 in Part 2 of Schedule 1 is the amount prescribed in column 3 of the item.

  • (2)

    For the purposes of subparagraph 14 (1) (d) (i) of the Act and subject to regulation 12, the fee for a category of film for sale or hire (other than a film mentioned in subregulation (4)) specified in an item in column 2 in Part 3 of Schedule 1 is the amount prescribed in column 3 of the item.

    (3)For subparagraph 14 (1) (d) (i) of the Act and subject to subregulation 12, the fee for a category of film for public exhibition and for sale or hire (other than a film mentioned in subregulation (4)) specified in an item in column 2 in Part 4 of Schedule 1 is the amount prescribed in column 3 of the item.

  • (4)

    For subparagraph 14 (1) (d) (i) of the Act and subject to subregulation 12, the fee for a category of interactive or click-on access film for public exhibition or for sale or hire specified in an item in column 2 in Part 5 of Schedule 1 is the amount prescribed in column 3 of the item.

6Fee for classification of a computer game

 For the purposes of paragraph 17 (1) (d) of the Act and subject to regulation 12, the fee for a category of computer game specified in an item in column 2 in Part 6 of Schedule 1 is the amount prescribed in column 3 of the item.

7Fee for certain information

 For subsection 27 (2) of the Act, the fee for information specified in an item in column 2 in Part 7 of Schedule 1 is the amount prescribed in column 3 of the item.

8Fee for approval of an advertisement

 For the purposes of paragraph 29 (2) (d) of the Act, the fee for a category of advertisement specified in an item in column 2 in Part 8 of Schedule 1 is the amount prescribed in column 3 of the item.

9Application fee for certificate of exemption for a film for advertising purposes

 For paragraph 32 (2) (d) of the Act, the fee for a certificate of exemption for a film for advertising purposes is $200.

10Fee for review of a decision

  • (1)

    For the purposes of paragraph 43 (1) (d) of the Act, the fee for review of a decision referred to in Part 1 or 2 of Schedule 2 in relation to an article specified in column 2 in an item in the relevant Part is the amount prescribed in column 3 of the item.

  • (2)

    For the purposes of paragraph 43 (1) (d) of the Act, the fee for review of a decision specified in an item in column 2 in the following table is the amount prescribed in column 3 in the item:

10APowers of Director under State or Territory laws

 For subparagraph 53 (b) (iii) of the Act, the Director may exercise powers conferred on him or her by the following provisions:

  • (a)

    sections 8 and 29 of the Classification (Publications, Films and Computer Games) Enforcement Act 1995 of New South Wales;

  • (b)

    sections 7, 17 and 35 of the Classification (Publications, Films and Computer Games) (Enforcement) Act 1995 of Victoria;

  • (c)

    section 30 of the Classification of Films Act 1991 of Queensland;

  • (d)

    section 15 of the Classification of Computer Games and Images Act 1995 of Queensland;

  • (e)

    sections 29, 39 and 55 of the Classification (Publications, Films and Computer Games) Act 1995 of South Australia;

  • (f)

    sections 67, 75 and 83 of the Censorship Act 1996 of Western Australia;

  • (g)

    sections 21, 34 and 50 of the Classification (Publications, Films and Computer Games) Enforcement Act 1995 of Tasmania;

  • (h)

    sections 7, 17 and 34 of the Classification (Publications, Films and Computer Games) (Enforcement) Act 1995 of the Australian Capital Territory;

  • (i)

    sections 36, 46 and 50L of the Classification of Publications, Films and Computer Games Act 1995 of the Northern Territory.

11Fee for issue of a certificate under section 87

For the purposes of section 87 of the Act and subject to regulation 12, the fee for a certificate specified in an item in column 2 in the following table is the amount prescribed in column 3 in the item:

12When certain fees are reduced or not payable

  • (1)

    In this regulation:

    eligible document means:

    • (a)

      an application for the classification of a publication, film or computer game; or

    • (b)

      a copy of a classification certificate under section 27 of the Act; or

    • (c)

      a certificate issued under section 87 of the Act.

    year means a period of 12 months commencing on the commencement of these Regulations or a succeeding period of 12 months.

  • (2)

    The fee for an eligible document is not payable by a State or Territory in a year, if:

    • (a)

      the eligible document is requested by the State or Territory in relation to enforcement of a law of the State or Territory that complements the Act for the purposes of the scheme referred to in section 3 of the Act; and

    • (b)

      this subregulation has not applied previously in that year in relation to the State or Territory to more than 100 eligible documents.

  • (3)

    If subregulation (2) has applied in a year in relation to a State or Territory to 100 eligible documents, the fee payable by the State or Territory for an application for the classification of a publication, film or computer game that:

    • (a)

      relates to enforcement of a law of the State or Territory to which paragraph (2) (a) refers; and

    • (b)

      is made later in that year;

     is 50% of the relevant fee prescribed in regulation 4, 5 or 6, as the case may be.
