Classification (Publications, Films and Computer Games) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Classification (Publications, Films and Computer Games) Act 1995.

1.   Commencement

1.1   These Regulations commence on 1 November 1997.

2.   Amendment

2.1   The Classification (Publications, Films and Computer Games) Regulations are amended as set out in these Regulations.

3.   Regulation 3 (Definitions)

3.1   Insert the following definitions:

‘interactive or click-on access film’, means a film referred to in subsection 14 (4) of the Act;

‘revised version’, in relation to a film, means a film that has been classified and is subsequently modified, other than by changing the title of the film, by the addition, deletion or alteration of audio or visual content in the film;

‘running time’, in relation to a film, means the audio or visual content of a film measured in elapsed time from the first sound or image to the final sound or image;

‘title change’ means a film that has been classified and is subsequently modified by the replacement of the title under which the film was classified with another title;

‘trailer’ means an audio-visual recording advertising a film or a computer game that contains selected extracts or images from the film or computer game that is being advertised.”.

4.   Regulation 4 (Fee for classification of a publication)

4.1   Omit all the words after “column 2” (including the table), substitute “in Part 1 of Schedule 1 is the amount prescribed in column 3 of the item.”.

5.   Regulation 5 (Fee for classification of a film)

5.1   Subregulation 5 (1):

Omit all the words after “public exhibition” (including the table), substitute “(other than a film mentioned in subregulation (4)) specified in an item in column 2 in Part 2 of Schedule 1 is the amount prescribed in column 3 of the item.”.

5.2   Subregulation 5 (2):

Omit all the words after “hire” (including the table), substitute “(other than a film mentioned in subregulation (4)) specified in an item in column 2 in Part 3 of Schedule 1 is the amount prescribed in column 3 of the item.”.

5.3   New subregulations 5 (3) and (4):

After subregulation 5 (2), insert:

 “(3) For subparagraph 14 (1) (d) (i) of the Act and subject to subregulation 12, the fee for a category of film for public exhibition and for sale or hire (other than a film mentioned in subregulation (4)) specified in an item in column 2 in Part 4 of Schedule 1 is the amount prescribed in column 3 of the item.

 “(4) For subparagraph 14 (1) (d) (i) of the Act and subject to subregulation 12, the fee for a category of interactive or click-on access film for public exhibition or for sale or hire specified in an item in column 2 in Part 5 of Schedule 1 is the amount prescribed in column 3 of the item.”.

6.   Regulation 6 (Fee for classification of a computer game)

6.1   Regulation 6:

Omit all the words after “column 2” (including the table), substitute “in Part 6 of Schedule 1 is the amount prescribed in column 3 of the item.”.

7.   Regulation 7 (Fee for copy of a classification certificate)

7.1   Omit the regulation, substitute:

Fee for certain information

 “7. For subsection 27 (2) of the Act, the fee for information specified in an item in column 2 in Part 7 of Schedule 1 is the amount prescribed in column 3 of the item.”.

8.   Regulation 8 (Fee for approval of an advertisement)

8.1   Regulation 8:

Omit all the words after “column 2” (including the table), substitute “in Part 8 of Schedule 1 is the amount prescribed in column 3 of the item.”.

9.   Regulation 9 (Fee for application for a certificate of exemption)

9.1   Omit the regulation, substitute:

Application fee for certificate of exemption for a film for advertising purposes

 “9. For paragraph 32 (2) (d) of the Act, the fee for a certificate of exemption for a film for advertising purposes is $200.”.

10.   Regulation 10 (Fee for review of decision)

10.1   Subregulation 10 (1):

Omit all the words after “decision” (including the table), substitute “referred to in Part 1 or 2 of Schedule 2 in relation to an article specified in column 2 in an item in the relevant Part is the amount prescribed in column 3 of the item.”.

10.2   Subregulation 10 (2):

Item 1:

Omit “200”, substitute “210”.

10.3   Subregulation 10 (2):

Items 2 and 3:

Omit “400”, substitute “420”.

10.4   Subregulation 10 (2):

After item 3, insert:

11.   Regulation 11 (Fee for issue of a certificate under section 87)

11.1   Item 1:

Omit “75”, substitute “80”.

11.2   Item 2:

Omit “100”, substitute “200”.

11.3   Item 3:

Omit “125”, substitute “110”.

12.   New Schedules 1 and 2

12.1   After regulation 12, insert:
