Legislative history

1—Short title

These regulations may be cited as the Classification of Theatrical Performances Regulations 1993.

2—Commencement

These regulations will come into operation on 1 September 1993.

3—Revocation

All regulations previously made under the Classification of Theatrical Performances Act 1978 are revoked.

4—Interpretation

In these regulations, unless the contrary intention appears—

the Act means the Classification of Theatrical Performances Act 1978.

5—Application fee

The fee for a request for the classification of a theatrical performance under the Act is $35.

6—Advertisements

  1. A person who publishes an advertisement falsely indicating that a theatrical performance has been classified by the Board as a restricted or unrestricted theatrical performance, or has been refused classification by the Board, is guilty of an offence.

    Penalty: $200.

  2. It is a defence to a charge of an offence against subregulation (1) if the defendant proves—

    (a)that he or she took no part in determining the contents of the advertisement; and

    (b)that he or she could not reasonably be expected to have known that the advertisement contravened this regulation.

7—Display of sign at restricted theatrical performance

  1. If a restricted theatrical performance is about to take place, or is taking place, in a theatre, a sign complying with subregulation (2) must be displayed in a conspicuous place where it may be conveniently read by any person entering the theatre.

  2. The sign must be easily legible and contain the following:

  1. If a sign is not displayed as required by this regulation, the promoter of the theatrical performance is guilty of an offence.

    Penalty: $200.
