  1. Name of regulation

    This regulation is the Civil Law (Sale of Residential Property) Amendment Regulation 2015 (No 1).

  2. Commencement

    (1)This regulation (other than section 5) commences on the commencement of the Dangerous Substances (General) Amendment Regulation 2015 (No 1), section 3.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

    (2)Section 5 commences on the commencement of the Dangerous Substances (General) Amendment Regulation 2015 (No 2), section 3.

  3. Legislation amended

    This regulation amends the Civil Law (Sale of Residential Property) Regulation 2004.

  4. New section 10A

    insert

10ARequired document—Act, s 9 (1) (k)

(1)This section applies in relation to a sale of residential property if—

(a)affected residential premises are covered by the proposed contract; and

(b)the owner has an asbestos contamination identification report for the premises required under the Dangerous Substances (General) Regulation 2004, section 341.

(2)A copy of the asbestos contamination identification report is prescribed.

(3)In this section:

affected residential premises—see the Dangerous Substances (General) Regulation 2004, section 337.

10ARequired document—Act, s 9 (1) (k)

(1)This section applies in relation to a sale of residential property if—

(a)affected residential premises are covered by the proposed contract; and

(b)the owner has an asbestos contamination report for the premises required under the Dangerous Substances (General) Regulation 2004, section 342.

(2)A copy of the asbestos contamination report is prescribed.

(3)In this section:

affected residential premises—see the Dangerous Substances (General) Regulation 2004, section 337.

asbestos contamination report—see the Dangerous Substances (General) Regulation 2004, section 341 (1).
