1Name

This instrument is the Civil Aviation Safety Amendment (Part 101—High Power Rockets) Regulations 2020.

    Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Civil Aviation Act 1988.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Civil Aviation Safety Regulations 1998

Regulation 101.025

Omit “or rocket” (wherever occurring).

Subregulation 101.055(3)

Repeal the subregulation, substitute:

  1. (3)

    A person must not launch a rocket that:

    1. (a)

      is not an aircraft; and

    2. (b)

      is not a high power rocket within the meaning of the Space (Launches and Returns) Act 2018; and

    3. (c)

      is not a space object or part of a space object within the meaning of that Act;

in a way that creates a hazard to another person or to property.

Penalty: 50 penalty units.

Note: Hazards from high power rockets and space objects are regulated under the Space (Launches and Returns) Act 2018.

    Regulation 101.425 (definition of high power rocket)

Repeal the definition.

Regulation 101.450 (heading)

Repeal the heading, substitute:

101.450Rockets other than model rockets must be launched in approved area

Subregulation 101.450(1)

Repeal the subregulation, substitute:

  1. (1)

    A person may launch a rocket that is not a model rocket, or permit such a rocket to be launched, only in an approved area.

    Penalty: 10 penalty units.

    Note: CASA must publish details of the approval of an area (including any conditions) in NOTAM or on an aeronautical chart—see subregulation 101.030(7).

Subregulation 101.450(2)

Omit “a high power rocket, or permit a high power rocket”, substitute “a rocket that is not a model rocket, or permit such a rocket”.

Subregulation 101.455(1) (note)

Omit “101.030(5)”, substitute “101.030(7)”.
