Civil Aviation Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Civil Aviation Act 1988.

Regulation 159 of the Civil Aviation Regulations is repealed and the following regulations are substituted:

Procedure on radio failure

“159. If a radio failure or failure of radio navigation aid equipment precludes compliance with these Regulations, the pilot in command of the aircraft must comply with any relevant instructions issued by the Authority under regulation 159a.

Power of the Authority to issue instructions

“159a. The Authority must issue written instructions specifying the procedures to be followed by a pilot in command of an aircraft in the event of the failure of the aircraft’s radio or radio navigation aid equipment.

Manner of notifying instructions

“159b. Instructions issued under regulation 159a must be published in the AIP and NOTAMS.”.
