Civil Aviation Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Civil Aviation Act 1988.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Civil Aviation Regulations.

Qualification for grant of air traffic controller licence

2. Regulation 104 of the Principal Regulations is amended by omitting from paragraph (1) (a) “21” and substituting “18”.

Qualifications for grant of flight service officer licence

3. Regulation 114 of the Principal Regulations is amended by omitting from paragraph (1) (a) “21” and substituting “18”.

V.F.R. flights at less than 5,000 feet

4. Regulation 172 of the Principal Regulations is amended by omitting paragraphs (3) (c), (d) and (e) and substituting the following paragraphs:

“(c) at such a speed that the pilot in command has an adequate opportunity to observe any obstructions or other air-traffic in sufficient time to avoid a collision;

 

(d) by day; and

(e) at a distance:

(i) that is less than 10 miles from an aerodrome in respect of which an instrument approach procedure has been approved:

(a) where the pilot in command conducts the flight in accordance with the requirements relevant to the flight relating to reporting, broadcasting and maintaining a listening watch that are set out in the Aeronautical Information Publications; and

(b) where no aircraft conducting an I.F.R. operation is landing at the aerodrome; and

(c) where no aircraft conducting an I.F.R. operation has made a departure call as part of its departure from the aerodrome; and

(d) where the pilot in command of the helicopter ensures that the helicopter remains not less than 1 mile from any other helicopter approaching the aerodrome; or

(ii) that is not less than 10 miles from such an aerodrome;”.
