Civil Aviation Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Civil Aviation Act 1988.

1. Amendment

1.1 The Civil Aviation Regulations are amended as set out in these Regulations.

2. New regulation 272A.

2.1 Before regulation 273, insert in Part XV:

Aircraft for the purposes of Division 2 of Part VI of the Act

“272a. For the purposes of paragraph (b) of the definition of ‘aircraft’ in subsection 3 (1) of the Act, the following are prescribed:

(a) all kinds of machines or craft that can derive support in the atmosphere from the reactions of the air:

(b) all kinds of objects designed or adapted for use as aircraft but incapable of being so used because:

(i) a part has, or parts have, been removed; or

(ii) they are in a wrecked or damaged condition.”.
