Civil Aviation Regulations 2(Amendment)

 

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Civil Aviation Act 1988.

1.   Amendment

1.1    The Civil Aviation Regulations are amended as set out in these Regulations.

  

2.   Regulation 16 (Nationality and registration marks)

2.1   After subregulation 16 (8), add:

“(9)

If an Australian aircraft does not comply with a requirement specified in subregulation (6), (7) or (8), the holder of the certificate of registration of the aircraft is guilty of an offence punishable, on conviction, by a fine not exceeding:

(a)

for a contravention of subregulation (6)—$1,000; or

 (b)

for a contravention of subregulation (7) or (8)—$500.”.

  

3.   Regulation 18 (Type and measurements of letters for marks)

3.1   Subregulation 18 (1):

Omit “The type of letters for nationality marks and registration marks and their measurements shall, subject to regulation 19, be”, substitute “The holder of the certificate of registration of an Australian aircraft must ensure that the type, and measurements, of letters for nationality marks and registration marks on the aircraft are”.

  

4.   Regulation 19 (Marking of certain heavier—than-air aircraft)

4.1   Omit “the marks shall”, substitute “the holder of the certificate of registration of the aircraft must ensure that the nationality marks and registration marks”.

  

5.   Regulation 20 (Advertisements and owner’s marks)

5.1   Subregulation 20 (1):

Omit “An Australian aircraft shall”, substitute “The holder of the certificate of registration of an Australian aircraft must ensure that the aircraft does”.

  

6.   Regulation 22b (Automatically issued certificates of type approval—imposition of conditions)

6.1   Add at the end:

“(4)

A person must not contravene a condition to which a certificate of type approval is subject.

 

Penalty:  $5,000.”.

  

7.   Regulation 25 (Conditions of certificates of airworthiness)

7.1   After subregulation 25 (1a), insert:

 “(1B) A person must not contravene a condition subject to which a certificate of airworthiness is issued.

 

Penalty:   $5,000.”.

7.2   Subregulation 25 (3):

Omit “furnish”, substitute “give”.

7.3   Add at the end:

“(4)

The owner or operator of an aircraft who is directed to give to the Authority documents or other evidence must comply with the direction as soon as practicable after receiving it.

 

Penalty:

  $500.”.

  

8.   Regulation 29 (Damage etc. to aircraft of a Contracting State)

8.1   Add at the end:

“(6)

A person must not fly an aircraft in contravention of a direction, or any condition imposed by a direction, given under this regulation.

 

Penalty:

  $5,000.”.

  

9.   Regulation 30 (Certificates of approval)

9.1   After subregulation 30 (3), insert:

 “(3A) A person must not, without reasonable excuse, contravene a condition to which a certificate of approval is subject.

 

Penalty:

  $2,500.”.

 

9.2   After subregulation 30 (4), insert:

 “(4a) The holder of a certificate of approval must give to an authorised person the evidence required under paragraph (4) (d).

 

Penalty:

  $500.”.

 

10.   Regulation 31 (Aircraft maintenance engineer licences)

10.1   After subregulation 31 (2), insert:

 “(2a) A person must not carry out work that exceeds the limits of the work specified in an endorsement on his or her licence.

 

Penalty:

  $2,500.”.

10.2   After subregulation 31 (3), insert:

 “(3a) A person must not, without reasonable excuse, contravene a condition subject to which his or her licence is granted.

 

Penalty:

  $2,500.”.

  

11.   Regulation 34 (Systems of certification of completion of activities)

11.1   After subregulation (3), insert:

 “(3a) A person must not, without reasonable excuse, contravene a direction under subregulation (1), (2) or (3).

 

Penalty:  $2,500.”.

 

11.2   Subregulation 34 (5):

Add at the foot of the subregulation:

 

“Penalty for a contravention of this subregulation:  $5,000.”.

  

12.   Regulation 35 (Approval of design of modification or repair)

12.1   After subregulation 35 (7), insert:

 “(7a) A person must not, without reasonable excuse, contravene a requirement included in an approval.

 

Penalty:  $5,000.”.

  

13.   Regulation 37 (Permissible unserviceabilities)

13.1   After subregulation 37 (2), insert:

 “(2a) A person must comply with a condition set out in a direction.

 

Penalty: $5,000.”.

  

14.   Regulation 38 (Requirements for the maintenance of Australian aircraft)

14.1   Subregulation 38 (4):

Add at the foot of the subregulation:

 

“Penalty:

(a)

for an offence against paragraph (4) (a)—$1,000; or

(b)

for an offence against paragraph (4) (b)—$5,000.”.

14.2   Add at the end:

“(11)

A person must not, without reasonable excuse, contravene a direction or a requirement included in a direction.

 

Penalty:  $5,000.”.

  

15.   Regulation 43 (Maintenance releases in respect of Australian aircraft)

15.1   Subregulation 43 (11):

Add at the foot of the subregulation:

 

“Penalty:  

(a)

for a contravention of subregulation (1)—$2,500; or

(b)

for a contravention of subregulation (6)—$2,500; or

(c)

for a contravention of subregulation (7)—$5,000; or

(d)

for a contravention of subregulation (10)—$1,000.”.

 

15.2   After subregulation 43 (11), insert:

 “(11a) A person must not contravene:

(a)

a direction; or

(b)

the condition specified in subregulation (3); or

(c)

a condition to which a maintenance release is subject.

 

Penalty:

  • (a)

    for a contravention of a direction under subregulation (2)—$1,000; or

  • (b)

    for a contravention of the condition specified in subregulation (3)—$1,000; or

  • (c)

    for a contravention of a direction under subregulation (4) or (5)—$500; or

  • (d)

    for a contravention of a condition under subregulation (9)—$5,000.”

 

15.3   After subregulation 43 (13), insert:

 “(13a) A person must not contravene subregulation (13).

 

Penalty:

  • (a)

    if the person signs the maintenance release in contravention of paragraph (13) (a) or (b)—$5,000; or

  • (b)

    if the person signs the maintenance release in contravention of paragraph (13) (c)—$1,000; or

  • (c)

    if the person signs the maintenance release in contravention of paragraph (13) (d)—$2,500.”.

  

16.   Regulation 44 (Conditions with respect to maintenance releases)

16.1   Add at the end:

“(3)

A person must not, without reasonable excuse, contravene a condition set out in a direction.

 

Penalty:  $2,500.”.

  

17.   Regulation 53 (Investigation of defects of Australia aircraft)

17.1   After subregulation 53 (3), insert:

 “(3a) A person must comply with an order.

 

Penalty:  $1,000.”.

  

18.   Regulation 54 (Records in relation to maintenance)

18.1   After subregulation 54 (4), insert:

 “(4A) The owner or operator of an aircraft must not, without reasonable excuse, contravene a direction under subregulation (4).

 

Penalty:  $500.”.

  

19.   Regulation 55b (Grant of licences)

19.1   After subregulation 55B (2), insert:

 “(2A) A person must not contravene a condition subject to which his or her licence is granted or endorsed.

 

Penalty:  $5,000.”.

  

20.   Regulation 57 (Privileges and limitations according to the category of licence held)

20.1   Add at the end:

“(15)

A person must not fly an aircraft in contravention of the privileges and limitations prescribed by this regulation.

 

Penalty:  $5,000.”.

 

21.   Regulation 63 (Authority may grant licence in certain circumstances where person ineligible)

21.1   After subregulation 63 (5), insert:

 “(5a) A person must not contravene a condition subject to which the licence is granted.

 

Penalty:  $5,000.”.

  

22.   Regulation 66 (Pilot licence to be in respect of particular types and categories of aircraft)

22.1   After subregulation 66 (2), insert:

 “(2a) Subject to subregulation (4), a person must not fly a type or category of aircraft that is not specified in an endorsement on his or her licence.

 

Penalty:  $5,000.”.

 

22.2   After subregulation 66 (4), insert:

 “(4A) An authorised pilot must not contravene a condition to which the authority is subject.

 

Penalty:  $2,500.”.

  

23.   Regulation 71 (Flight time limitations on holders of licences other than private pilot licences)

23.1   Add at the end:

“(2)

A person must not, without reasonable excuse, contravene a direction.

 

Penalty:  $2,500.”.

  

24.   Regulation 72c (Limited medical certificates)

24.1   After subregulation 72c (4), add:

 “(4a) A person must not contravene a condition subject to which a medical certificate is granted.

 

Penalty:  $5,000.”.

 

25.   Regulation 72d (Medical certificates)

25.1   After subregulation 72d (3), insert:

 “(3a) A person must not contravene a condition subject to which a medical certificate is granted.

 

Penalty:  $5,000.”.

  

26.   Regulation 80 (Retention of log books and logs)

26.1   Add at the end:

“(2)

The person keeping the log or log book must not, without reasonable excuse, contravene a direction.

 

Penalty:  $500.”.

  

27.   Regulation 88 (Licensing of aerodromes)

27.1   After subregulation 88 (2), insert:

 “(2a) The proprietor must not, without reasonable excuse, contravene a condition subject to which the aerodrome licence is granted.

 

Penalty:   $2,500.”.

  

28.   Regulation 92 (Use of aerodromes etc.)

28.1   Add at the end:

“(3)

A person must not contravene a direction.

 

Penalty:

  $2,500.”.

  

29.   Regulation 94 (Dangerous lights)

29.1   Subregulation 94 (2):

Omit “offence.”, substitute “offence punishable, on conviction, by a fine not exceeding $2,500.”.

  

30.   Regulation 95 (Removal or marking of objects which constitute obstructions or potential hazards to air navigation)

30.1   Subregulation 95 (3):

Omit “offence,”, substitute “offence punishable, on conviction, by a fine not exceeding $2,500,”.

31.   Regulation 102 (Air traffic controller to be specially authorised or licensed)

31.1   Add at the end:

“(4)

A person must not contravene a condition to which his or her licence, or a rating endorsed on his or her licence, is deemed to be subject.

 

Penalty:

  $2,500.”.

  

32.   Regulation 108 (Licence issued by authority other than Australian)

32.1   Add at the end:

“(2)

A person must not contravene a condition or limitation subject to which his or her air traffic controller licence is granted.

 

Penalty:

  $2,500.”.

  

33.   Regulation 112 (Flight Service officers to be specially authorised or licensed)

33.1   Add at the end:

“(4)

A person must not contravene a condition to which:

(a)

his or her licence; or

(b)

a rating endorsed on his or her licence;

is subject.

 

Penalty:

  $2,500.”.

  

34.   Regulation 118 (Licence issued by authority other than Australian)

34.1   Add at the end:

“(2)

A person must not contravene a condition or limitation subject to which his or her flight service officer licence is granted.

 

Penalty:

  $2,500.”.

  

35.   Regulation 120 (Weather reports not to be used unless made with authority)

35.1   Omit “shall not be used”, substitute “must not be used by an operator or a pilot in command”.

36.   Regulation 134 (Permission for certain flights)

36.1   After subregulation 134 (2), insert:

 “(2a) A person must not, without reasonable excuse, contravene a direction.

 

Penalty:

  $2,500.”.

  

37.   Regulation 138 (Flight manual)

37.1   After subregulation 138 (1), insert:

 “(1a) A person who is the manufacturer, owner or operator of an aircraft must not issue:

(a)

a flight manual for the aircraft; or

(b)

alterations to the flight manual for the aircraft;

unless the person is authorised to do so.

 

Penalty:

  $5,000.”.

 

37.2   After subregulation 138 (3), insert:

 “(3a) The owner or operator of an Australian aircraft to whom a direction is issued under subregulation (3) must not contravene the direction.

 

Penalty:

  $2,500.”.

 

37.3   Subregulation 138 (4):

Add at the foot of the subregulation:

 

“Penalty for a contravention of this subregulation: $5,000.”.

  

38.   Regulation 141 (Flying training areas)

38.1   Add at the end:

“(3)

A person must not:

  • (a)

    fly an aircraft for the purposes of flying training in an area that is not designated as a flying training area; or

  • (b)

    engage in low flying or acrobatic flying in a designated flying area for the purposes of flying training except in accordance with an authorisation.

 

Penalty:

  $5,000.”.

  

39.   Regulation 158 (Reports at designated points or intervals)

39.1   After “reported”, insert “by the pilot in command”.

  

40.   New regulation 169a

40.1   After regulation 169, insert the following regulation in Division 2:

 

Offences

 “169a. A pilot in command:

(a)

who contravenes regulation 166 or 167; or

(b)

who flies an aircraft in contravention of:

 (i) a rule specified in subregulation 168 (1); or

 (ii) subregulation 169 (1), (2) or (3); or

 (iii) a rule specified in subregulation 169 (4) or (5);

is guilty of an offence.

 

Penalty:  $2,500.”.

  

41.   Regulation 174a (Equipment of aircraft for V.F.R. flight)

41.1   Add at the end:

“(5)

An aircraft must not be flown in contravention of a condition specified in a permission given in relation to the aircraft.

 

Penalty:

  $2,500.”.

  

42.   Regulation 174c (Qualifications for night flying under V.F.R.)

42.1   After subregulation 174c (2), insert:

 “(2a) A pilot to whom permission has been given must not contravene a term or condition of the permission.

 

Penalty:   $2,500.”.

  

43.   Regulation 176 (Qualification of pilot in command)

43.1   After subregulation 176 (2), insert:

 “(2a) A pilot in command to whom permission has been given must not, without reasonable excuse, contravene a term of the permission.

 

Penalty:

  $5,000.”.

  

44.   Regulation 177 (Equipment of aircraft for I.F.R. flight)

44.1   Add at the end:

“(5)

An aircraft to which subregulation (3) or (4) applies must not be flown in contravention of a condition specified in the permission.

 

Penalty:

45.   New regulation 205a

45.1   After regulation 205, insert the following regulation in Division 4 of Part XII:

 

Offences

 “205a. A person who flies or operates:

(a)

an aeroplane; or

(b)

a glider; or

(c)

a balloon; or

(d)

a kite; or

(e)

an airship;

in contravention of a provision of this Division that applies to the aeroplane, glider, balloon, kite or airship is guilty of an offence punishable, on conviction, by a fine not exceeding $2,500.”.

  

46.   Regulation 215 (Operations manual)

46.1   After subregulation 215 (3), insert:

 “(3a) An operator must not, without reasonable excuse, contravene a direction.

 

Penalty:

  $2,500.”.

  

47.   Regulation 218 (Route qualifications of pilot in command of a regular public transport aircraft)

47.1   Subregulation 218 (1):

Add at the foot of the subregulation:

When an aircraft is in flight, the pilot in command must ensure that all exits to which this regulation applies are fastened in a way that permits their immediate use in an emergency.

Omit “subregulations (1) and”, substitute “subregulation”.

Omit “Notwithstanding subregulations (1), (2) and (3), a person shall not be convicted of an offence against this regulation”, substitute “In spite of anything else in these Regulations, a person is not guilty of an offence against a provision of these Regulations”.
