Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Civil Aviation Act 1988.

1.   Amendment

1.1   The Civil Aviation Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 310A (Determination of safety audit programs)

2.1   Subregulation 310A (1):

Omit “1994, determine a safety audit program”, substitute “1995, determine one or more safety audit programs”.

2.2   Subregulation 310A (2):

Omit the subregulation, substitute:

“(2)

The Authority must not determine more than 1 safety audit program in relation to the same operator for each of the following periods:

• (a)

  the period starting on 29 October 1993 and ending on 1 July 1994;

• (b)

  the period starting on 1 July 1994 and ending on 1 July 1995.”.

3.   Regulation 310B (Carrying out safety audit programs)

3.1   Subregulation 310B (2):

Omit “1994”, substitute “1995”.

4.   Regulation 310C

4.1   After regulation 310B, insert in Part XVIII:

Safety audits do not affect exercise of other powers etc.

“310C.

Regulations 310A and 310B do not affect the carrying out or exercise of any duty, function or power imposed or conferred on the Authority or any other person by or under anything in the Act or any other provision of these Regulations.”.

5.   Transitional

5.1   A safety audit program determined under regulation 310A of the Civil Aviation Regulations is, after the commencement of these Regulations, taken to have been determined under that regulation as amended by these Regulations.
