Civil Aviation Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Civil Aviation Act 1988.

1.   Commencement

1.1   These Regulations are taken to have commenced on 12 October 1994.

2.   Amendment

2.1   The Civil Aviation Regulations are amended as set out in these Regulations.

3.   New regulation 4A

3.1   After regulation 4, insert:

Prescribed functions of Authority—advising Minister etc.

 “4A.(1)For the purposes of paragraph 9 (1) (k) of the Act, the Authority has the functions specified in subregulation (2) relating to any of the matters referred to in subsection 9 (1) of the Act.

 “(2) For the purposes of subregulation (1), the following functions are specified:

  • (a)

    to give advice, or to procure advice to be given, to the Minister or to the Department;

  • (b)

    to meet the costs of the provision of any advice to the Minister or to the Department (including advice referred to in paragraph (a));

  • (c)

    to implement any administrative arrangements (including arrangements relating to the establishment of:

    • (i)

      a body to be known as the Civil Aviation Safety Authority; and

    • (ii)

      a body to be known as Airservices Australia).”.
