Civil Aviation Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Civil Aviation Act 1988.

1.   Commencement

1.1 These Regulations commence when section 3 of the Civil Aviation Legislation Amendment Act 1995 commences.

2.   Amendment

2.1   The Civil Aviation Regulations are amended as set out in these Regulations.

3.   Regulation 2 (Interpretation)

3.1   Subregulation 2 (1) (definitions of “CAA flying operations inspector”, “CAA maintenance schedule”, “CAA system of certification of completion of maintenance” , “the Council”):

Omit the definitions.

3.2   Subregulation 2 (1) (definitions of “aerodrome reference point”, “air law examination”, “airship instructor”, “approved”, “authorised”, “chief flying instructor”, “Civil Aviation Orders”, “flight radiotelephone practical test”, “flight test”, “flying training area”, “instrument ground time”, “maintenance instruction”, “meteorological minima”, “meteorological observer”, “permissible unserviceability”, “radiotelephonic language”, “specific subject”, “theory examination”, and “time-lifed aircraft component”):

Omit “the Authority” (wherever occurring), substitute “CASA”.

3.3   Subregulation 2 (1) (definition of “Aeronautical Information Publications” or “AIP”):

Omit the definition, substitute:

‘Aeronautical Information Publications’ or ‘AIP’ has the meaning given by regulation 4.12 of the Air Services Regulations;”.

3.4   Subregulation 2 (1) (definition of “Air Traffic Control”):

Omit the definition, substitute:

‘Air Traffic Control’ means ATS in its capacity as the provider of air traffic control services;”.

3.5   Subregulation 2 (1) (definition of “air traffic control service”):

Omit the definition, substitute:

‘air traffic control service’ means any service provided by ATS when performing a function referred to in paragraph 8 (1) (b) of the Air Services Act 1995;”.

3.6   Subregulation 2 (1) (definition of “approved testing officer”):

Omit from paragraphs (a) and (b) “Chief Executive Officer”, substitute “Director”.

3.7   Subregulation 2 (1) (definition of “aviation authority”):

Omit from paragraph (a) “Civil Aviation Authority”, substitute “CASA”.

3.8   Subregulation 2 (1) (definition of “check flight engineer”):

Omit “Chief Executive Officer”, substitute “Director”.

3.9   Subregulation 2 (1) (definition of “control area”):

Omit the definition, substitute:

‘control area’ means airspace to which a determination under paragraph 2.04 (1) (d) of the Air Services Regulations applies;”.

3.10   Subregulation 2 (1) (definition of “controlled aerodrome”):

Omit the definition, substitute:

‘controlled aerodrome’ means an aerodrome to which a determination under paragraph 2.04 (1) (a) of the Air Services Regulations applies;”.

3.11   Subregulation 2 (1) (definition of “control zone”):

Omit the definition, substitute:

‘control zone’ means airspace to which a determination under paragraph 2.04 (1) (e) of the Air Services Regulations applies;”.

3.12   Subregulation 2 (1) (definition of “daily inspection”):

Omit from paragraphs (a) and (b) “CAA”, substitute “CASA”.

3.13   Subregulation 2 (1) (definition of “danger area”):

Omit the definition, substitute:

‘danger area’ means an area declared under regulation 2.07 of the Air Services Regulations to be a danger area;”.

3.14   Subregulation 2 (1) (definition of “flight information area”):

Omit the definition, substitute:

‘flight information area’ means airspace to which a determination under subparagraph 2.04 (1) (c) (i) of the Air Services Regulations applies;”.

3.15   Subregulation 2 (1) (definition of “Flight Service”):

Omit the definition, substitute:

‘Flight Service’ means flight advisory services provided by ATS;”.

3.16   Subregulation 2 (1) (definition of “flying training area”):

Omit from paragraph (b) “Authority under subregulation 141 (1)”, substitute “AA under regulation 2.09 of the Air Services Regulations”.

3.17   Subregulation 2 (1) (definition of “Notices to Airmen” “NOTAMS”):

Omit the definition, substitute:

‘Notices to Airmen’ or ‘NOTAMS’has the meaning given by regulation 4.12 of the Air Services Regulations;”.

3.18   Subregulation 2 (1) (definition of “prohibited area”):

Omit the definition, substitute:

‘prohibited area’ means an area declared under regulation 2.07 of the Air Services Regulations to be a prohibited area;”.

3.19   Subregulation 2 (1) (definition of “restricted area”):

Omit the definition, substitute:

‘restricted area’ means an area declared under regulation 2.07 of the Air Services Regulations to be a restricted area;”.

3.20   Subregulation 2 (1):  

Insert the following definitions:

‘air traffic’ has the same meaning as in subregulation 1.03 (1) of the Air Services Regulations;

‘AA’ means the body called Airservices Australia established by subsection 7 (1) of the Air Services Act 1995;

‘Air Traffic Service’ means AA in its capacity as the provider of air services under subparagraph 8 (1) (b) (i) of the Air Services Act 1995;

‘ATS’ means the Air Traffic Service;

‘CASA flying operations inspector’ means a person employed by CASA as:

  • (a)

    a flying operations inspector (however called); or

  • (b)

    a  senior flying operations inspector (however called);

‘CASA maintenance schedule’ means the schedule of maintenance set out in Schedule 5;

‘CASA system of certification of completion of maintenance’ means the system of certification of completion of maintenance set out in Schedule 6;

‘class of airspace’ means a class of airspace determined under subregulation 2.4.1 (1) of the Air Services Regulations;

‘facilities’, in relation to an air route or airway, has the same meaning as in subregulation 1.03 (1) of the Air Services Regulations;

‘movement area’, in relation to an aerodrome, has the same meaning as in subregulation 1.03 (1) of the Air Services Regulations;”.

4.   Regulation 4 (Authority)

4.1   The heading to regulation 4 should be read as “CASA”.

5.   Regulation 4A (Prescribed functions of Authority—advising Minister etc.)

5.1  Omit the regulation.

6.   Regulation 7 (Delegation)

6.1   Subregulation 7 (1):

Omit “Chief Executive Officer”, substitute “Director”.

7.   Regulation 13B (Certificate of registration)

7.1   Subregulation 13B (1):

Omit “, on payment of any applicable charge determined under section 66 of the Act,”.

8.   Regulation 13F (Certain particulars to be given to Authority)

8.1   The heading to regulation 13F should be read as “Certain particulars to be given to CASA”.

9.   Regulation 13I (Loss etc. of certificate of registration)

9.1   Subregulation 13I (4):

Omit “, on payment of any applicable charge determined under section 66 of the Act,”.

10.   Regulation 13S (Issue of new certificate of registration)

10.1   Subregulation 13S (5):

Omit “, on payment of any applicable charge determined under section 66 of the Act,”.

11.   Regulation 14 (Authority may ask for further particulars)

11.1   The heading to regulation 14 should be read as “CASA may ask for further particulars”.

12.   Regulation 16 (Nationality and registration marks)

12.1   Subregulation 16 (3):

Omit the subregulation, substitute:

“(3)

Subject to subregulations (3A) and (4), CASA must, at the request of a person who intends to register an aircraft, reserve for assignment to that aircraft, for a period not longer than 12 months, a group of 3 symbols, being letters or a combination of letters and numbers.”.

13.   Regulation 16A (Application for new registration mark)

13.1   Subregulation 16A (2):

Omit “, and on payment of any applicable charge determined under section 66 of the Act,”.

14.   Regulation 20B (Authority may declare recognised authorities)

14.1   The heading to regulation 20B should be read as “CASA may declare recognised authorities”.

15. Regulation 23 (Authority may notify

that certificate of type approval etc. a prerequisite for certificate of airworthiness)

15.1   The heading to regulation 20B should be read as “CASA may notify that certificate of type approval etc. a prerequisite for certificate of airworthiness”.

16.   Regulation 31A (Authority may specify activities relating to categories)

16.1   The heading to regulation 31A should be read as “CASA may specify activities relating to categories”.

17.   Regulation 42B (Maintenance schedule: CAA maintenance schedule)

17.1   The heading to regulation 42B should be read as “Maintenance schedule: CASA maintenance schedule)”.

18.   Regulation 42K (System of maintenance: submission to Authority)

18.1   The heading to regulation 42K should be read as “System of maintenance: submission to CASA”.

19.   Regulation 42Q (Authority may direct changes)

19.1   The heading to regulation 42Q should be read as “CASA may direct changes”.

20.   Regulation 51B (Defects discovered in complying with directions by the Authority)

20.1   The heading to regulation 51B should be read as “Defects discovered in complying with directions by CASA”.

21.   Regulation 5.09 (Flight crew licence: issue and refusal)

21.1   Subregulation 5.09 (1):

  • (a)

    Omit from paragraph (c) “licence; and”, substitute “licence.”.

  • (b)

    Omit paragraph (d).

22. Regulation 5.14 (Flight crew rating:

issue and refusal)

22.1   Subregulation 5.14 (2):

  • (a)

    Omit from paragraph (b) “rating; and”, substitute “rating.”.

  • (b)

    Omit paragraph (c).

23. Regulation 5.23 (Aircraft endorsement:

issue and refusal)

23.1   Subregulation 5.23 (2):

Omit everything after “if, and only if,”, substitute “the holder satisfies the requirements for the issue of the endorsement.”.

24.   Regulation 5.27 (Certificate of validation: issue)

24.1   Subregulation 5.27 (2):

  • (a)

    Omit from paragraph (c) “certificate; and”, substitute “certificate.”.

  • (b)

    Omit paragraph (d).

25. Regulation 5.198 (Special pilot licence:

issue and refusal)

25.1   Subregulation 5.198 (1):

  • (a)

    Omit from subparagraph (d) (iii) “applied; and”, substitute “applied.”.

  • (b)

    Omit paragraph (e).

26.   Regulation 82 (Equipment of Australian aircraft with radiocommunication systems)

26.1   Paragraph 82 (2) (a):

Omit “in pursuance of Part IX”, substitute “under the Air Services Act 1995;.

27. Regulation 83A (Aircraft radiotelephone operator certificate of proficiency:

issue)

27.1   Subregulation 83A (2):

  • (a)

    Omit from paragraph (b) “certificate; and”, substitute “certificate.”.

  • (b)

    Omit paragraph (c).

28.   Regulation 89C (Grant of aerodrome licence)

28.1   Subregulation 89C (1):

Omit “if the applicant has paid any charge under section 66 of the Act in relation to the application”.

29.   Regulation 94 (Dangerous lights)

29.1   Subregulation 94 (1):

Omit “operated in pursuance of Part IX”, substitute “provided under the Air Services Act 1995;.

30.   Regulation 99AA (Air Traffic—Services, directions and instructions)

30.1   Subregulation 99AA (5):

Omit the subregulation, substitute:

“(5)

CASA may give directions or instructions about the use of a class of airspace, a controlled aerodrome, a control area or a control zone by either or both of the following:

  • (a)

    aircraft engaged in I.F.R. flights;

  • (b)

    aircraft engaged in V.F.R. flights.”.

30.2   Regulation 99AA (5A):

Omit the subregulation, substitute:

“(5A)

If:

  • (a)

    an area of Australian territory has been declared to be a restricted area or a danger area; and

  • (b)

    the airspace above that area is, or is part of, a class of airspace;

CASA may give directions or instructions about the use of the airspace above that area that are different from instructions it gives under subregulation (5) about the use of the class of airspace.”.

31.   Regulation 132 (Statistical returns)

31.1   Subregulation 132 (2):

Omit the subregulation, substitute:

“(2)

An airline, or the owner of an aircraft engaged in public transport service, which uses any air route or airway facility maintained and operated by AA must give CASA or an authorised officer any traffic reports that CASA requires.”.

32.   Regulation 141 (Flying training areas)

32.1   Subregulations 141 (1) and (2):

Omit the subregulations, substitute:

“(1)

CASA may authorise low flying or acrobatic flying over a specified part of a flying training area.”.

33.   Regulation 297 (Evidence)

33.1   Paragraph 297 (3) (d):

Omit the paragraph.

34.   References to “the Authority” in Regulations and CAOs

34.1 Each provision in the Civil Aviation Regulations in which the expression “The Authority” or “the Authority”

 appears (except regulation 2) is amended by omitting the expression (wherever occurring) and substituting “CASA”.

34.2  Each provision in the Civil Aviation Regulations in which the expression “The Authority’s” or “the Authority’s” appears (except regulation 2) is amended by omitting the expression (wherever occurring) and substituting “CASA’s”.

34.3   The heading of Division 1B of Part III of the Civil Aviation Regulations is amended by omitting “the Authority” and substituting “CASA”.

34.4   The heading of Division 1 of Part IVA of the Civil Aviation Regulations is amended by omitting “Authority” and substituting “CASA”.

34.5 Each provision and heading in the Civil Aviation Orders in which the expression “The Authority” or “the Authority”

 appears is amended by omitting the expression (wherever occurring) and substituting “CASA”.

34.6  Each provision and heading in the Civil Aviation Orders in which the expression “The Authority’s” or “the Authority’s” appears is amended by omitting the expression (wherever occurring) and substituting “CASA’s”.

35.   References to “CAA” in Regulations and CAOs

35.1   Each of the following provisions of the Civil Aviation Regulations is amended by omitting “CAA” (wherever occurring) and substituting “CASA”:

  • (a)

36.    Repeals

36.1   Part IX (Air routes and airways) and Part XV (Application of Statutory Liens) of the Civil Aviation Regulations are repealed.

36.2   Each of the following Divisions and provisions of the Civil Aviation Regulations is omitted:

  • (a)

    Divisions 3 and 4 of Part IXB (regulations 121 to 131, inclusive);

  • (b)

    Regulations 97, 98, 99, 109, 110, 119, 211, and 310AA;

  • (c)

    Subregulations 33D (4), 33G (5), 33H (6), 5.09 (5), 5.14 (4), 5.23 (4), 5.27 (6), 5.198 (5), 83A (4), 99A (2), 99AA (1), 99AA (2), 99AA (4), 140 (1), 140 (2), 140 (3), 140 (4), 140 (7), 297A (3), 297A (4) and 310B (9);

  • (d)

    Paragraph 89G (1) (a).

37.    Notes

37.1.   The notes appearing in Divisions 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 and 16 of Part 5 of the Civil Aviation Regulations and listing the defined terms used in those Divisions are amended by omitting “CAA flying operations inspector” and substituting “CASA flying operations inspector” in each case.

37.2   The notes relating to, or appearing immediately below, each of the following provisions of the Civil Aviation Regulations are amended by omitting “the Authority” (wherever occurring) and substituting “CASA”:
