Civil Aviation Order 82.0 Amendment Order (No. 4) 2007

1          Name of instrument

            This instrument is the Civil Aviation Order 82.0 Amendment Order (No. 4) 2007.

2          Commencement

            This instrument commences on the day after it is registered.

            Schedule 1amends Civil Aviation Order 82.0.

Schedule 1          Amendments

[1]       After paragraph 1.1

   1.2     Civil Aviation Order 82.0, as in force immediately before the commencement of Civil Aviation Order 82.0 Amendment Order (No. 3) 2007 (Amendment Order (No. 3)), is taken to continue to apply to an AOC holder to whom the savings provision in section 3 of Amendment Order (No. 3) applies.

Note   The savings provision in section 3 of Amendment Order (No. 3) grandfathers the position of existing ETOPS approval holders until immediately before 1 July 2008. The provision in paragraph 1.2 above resurrects the previous version of CAO 82.0 solely so that it may continue to apply to these ETOPS approval holders during the grandfathered period.

   1.3     Subsection 1.2 only has effect in relation to aircraft of the same type as the aircraft to which the AOC holder’s ETOPS approval mentioned in section 3 of Amendment Order (No. 3) applies.

[2]       Paragraph 2.1, definition of adequate aerodrome, subparagraph (b)

(b)   provides facilities and services for the aeroplane type including:

             (i)  meteorological forecasts; and

            (ii)  at least 1 suitable authorised instrument approach procedure.

[3]       Paragraph 2.1, definition of EDTO alternate aerodrome

EDTO alternate aerodrome means an adequate aerodrome that:

(a)   is listed in the AOC holder’s EDTO safety operational specifications as being an aerodrome that may be designated as an alternate in the event of a diversion during an EDTO; and

(b)   for an aerodrome inside Australian territory — has CTAF(R); and

(c)   for an aerodrome outside Australian territory — has:

             (i)  air traffic control or air traffic services (with not more than 30 minutes’ notice); and

            (ii)  rescue and fire fighting services to Manual of Standards Part 139H category 4 (with not more than 30 minutes’ notice).

Note   This definition applies for flight planning and does not limit the discretion of the pilot in command during flight.
