  1. Name of Order

This Order is the Civil Aviation Amendment Order (No. R45) 2004.

  1. Commencement

This Order commences on gazettal.

  1. Replacement of section 43.0 of the Civil Aviation Orders

Section 43.0 of the Civil Aviation Orders is omitted and a new section substituted as set out in Schedule 1.

SECTION 43.0

FLIGHT ENGINEER

  1. CARRIAGE OF FLIGHT ENGINEER

A flight engineer shall be carried in an Australian aircraft:

(a)where the flight manual for that aircraft specifies that a flight engineer is included in the minimum crew requirements for the aircraft; or

(b)where the aircraft has provision for a flight engineer’s panel and CASA has specified that a flight engineer shall be carried; or

(c)in such other cases as CASA may direct, having regard to the regularity and safety of operations.

  1. TRAINING AND CHECKING ORGANISATION

An airline shall provide a training and checking organisation sufficient to ensure that each crew member employed by the airline is adequately trained to perform the duties to which he or she is to be assigned and nothing in this subsection shall be deemed to relieve an airline of this obligation.

  1. LOGGING OF FLIGHT TIME AND SIMULATOR TIME

3.1The holder of a flight engineer licence shall log as flight time all time he or she operates as flight engineer.

3.2The holder of a flight engineer licence shall log as simulator time all time he or she operates as flight engineer in an approved aircraft simulator.
