  1. Name of Order

This Order is the Civil Aviation Amendment Order (No. R39) 2004.

  1. Commencement

This Order commences on gazettal.

  1. Replacement of section 40.4.0 of the Civil Aviation Orders

Section 40.4.0 of the Civil Aviation Orders is omitted and a new section substituted as set out in Schedule 1.

SECTION 40.4.0

AIRCRAFT ENDORSEMENTS (AND LOG BOOK ENTRIES) — GYROPLANES

  1. INTERPRETATION

A reference in this section to a subregulation identified by a numerical code (for example, 5.22 (1)) is a reference to the subregulation in the Civil Aviation Regulations 1988 identified by that code.

  1. PRESCRIPTION OF ENDORSEMENTS

2.1For the purposes of subregulation 5.22 (1), the following type endorsements are prescribed for gyroplanes:

(a)Air and Space 18A;

(b)McCulloch J2.

  1. AUTHORITY GIVEN BY TYPE ENDORSEMENT

3.1A type endorsement prescribed in subsection 1 authorises the holder of the endorsement to fly a gyroplane of that type as pilot in command, or as co-pilot.

  1. REQUIREMENTS FOR ISSUE OF TYPE ENDORSEMENT

4.1For the purposes of subregulation 5.23 (1), the requirements for the issue of a type endorsement prescribed in subsection 1 are:

(a)the person seeking the endorsement must:

(i)hold a student pilot licence or a gyroplane pilot licence;  and

(ii)undertake training in the operating limitations procedures and systems of that type of gyroplane;  and

(iii)undertake flying training, or training in an approved synthetic flight trainer appropriate to the type of gyroplane, in normal and emergency flight manoeuvres and procedures in that type of gyroplane in accordance with Appendix I;  and

(iv)satisfy the person who conducted the training mentioned in sub-subparagraphs (ii) and (iii) that the first-mentioned person can safely fly that type of gyroplane;  or

(b)the person seeking the endorsement must hold or have held the pilot qualification:

(i)that CASA is satisfied is at least equivalent to the type endorsement sought;  and

(ii)that was issued by the Defence Force of Australia;  or

(c)the person seeking the endorsement must hold an overseas gyroplane type endorsement that is at least equivalent to the type endorsement sought.

4.2For the purposes of this subsection, an overseas type gyroplane endorsement is equivalent to a particular type endorsement for a gyroplane if both endorsements authorise the holder to fly that type of gyroplane in the same capacity.

4.3In this section:

overseas gyroplane type endorsement means a qualification (whether it is called an endorsement, rating or authority, or is known by some other name):

(a)that authorises the holder of the qualification to fly a particular type of gyroplane;  and

(b)that was issued by the responsible authority of a Contracting State.

  1. LOGGING OF FLIGHT TIME

6.5For the purposes of subregulation 5.52 (2), the information about each flight must include:

(a)the date of each flight; and

(b)the type and registration marks of the aircraft flown; and

(c)the name of the pilot in command; and

(d)the points of departure and destination of each flight; and

(e)the nature of each flight; and

(f)the time flown on instruments; and

(g)time flown in single and multi-engined aircraft by day and night.

6.6Flight time during which a pilot receives dual instruction shall be logged as dual.  Instrument flight in accordance with an approved syllabus of flying training for the issue of a licence shall be logged as dual.

6.7Flight time during which a pilot is in command shall be logged as in command.

6.8Flight time during which a pilot, who holds an aircraft endorsement for the aircraft concerned, serves in any pilot capacity other than pilot in command or pilot in command under supervision shall be logged as co-pilot.

6.9Instrument flight time shall be logged by the pilot manipulating the controls of an aircraft in flight, only when the aircraft is flown solely by reference to instruments under actual or simulated instrument conditions.

6.10Instrument ground time shall be logged by the pilot manipulating the controls of an approved synthetic flight trainer, only when the pilot is operating solely by reference to instruments under simulated instrument conditions.


APPENDIX I

FLIGHT TRAINING IN A DUAL CONTROL GYROPLANE

An applicant for a type endorsement for a gyroplane in a pilot licence is required to have received instruction in accordance with the following syllabus as applicable to the type of gyroplane used:

(a)Pre-flight inspection;

(b)General flying:

Starting, run up and shut down procedures;

Taxiing;

Take-off, circuit and landing;

Crosswind operations;

Missed approach procedure;

Flight at minimum airspeed in level flight;

Recovery from high rates of descent at airspeeds below minimum level flight airspeed;

Gyroplane systems management;

Actions in event of engine failure after take-off and in flight;

Forced landings;

(c)Instrument flying:

All normal manoeuvres;

(d)Night flying (where applicable):

Take-off, circuit and landing;

Missed approach.
