  1. Name of Order

This Order is the Civil Aviation Amendment Order (No. R38) 2004.

  1. Commencement

This Order commences on gazettal.

  1. Replacement of section 40.3.7 of the Civil Aviation Orders

Section 40.3.7 of the Civil Aviation Orders is omitted and a new section substituted as set out in Schedule 1.

SECTION 40.3.7

FLIGHT INSTRUCTOR (HELICOPTER) RATING

  1. APPLICATION

1.1For the purposes of subregulation 5.14 (1):

(a)the flight tests that must be passed; and

(b)other requirements that must be satisfied;

for the issue of each grade of flight instructor (helicopter) rating are set out in subsections 4, 5, 6 and 8.

1.2For the purposes of subregulation 5.14 (1):

(a)the flight tests that must be passed; and

(b)other requirements that must be satisfied;

for the renewal of a flight instructor (helicopter) rating are set out in subsection 10.

1.3For the purposes of regulation 5.18:

(a)the authority given by each grade of flight instructor (helicopter) rating; and

(b)the limitations of that authority; and

(c)the flight tests that must be passed, and other requirements that must be satisfied, before that authority may be exercised;

are set out in subsection 11.

  1. INTERPRETATION

2.1In this section, unless the contrary intention appears:

dual instruction means flying training in the aeronautical skills necessary for the issue of a flight instructor (helicopter) rating.

elementary helicopter flying training means flying training in the sequences set out in the helicopter syllabus that are required before a person attempts the general flying progress flight test for helicopters.

Grade 1 flight instructor means a person who holds a flight instructor (helicopter) rating grade 1.

Grade 2 flight instructor means a person who holds a flight instructor (helicopter) rating grade 2.

mutual practice means:

(a)flight time during which persons who have received dual instruction given by a Grade 1 flight instructor practise giving flying training to each other; or

(b)flight time during which a person who has received dual instruction given by a Grade 1 flight instructor practices giving flying training to a Grade 2 flight instructor.

2.2A reference in this section to a regulation or subregulation identified by a numerical code (for example, 5.18 or 5.22 (1)) is a reference to the regulation or subregulation identified by that code in the Civil Aviation Regulations 1988.

  1. AERONAUTICAL EXPERIENCE

4.1Aeronautical experience gained in approved synthetic flight trainers shall not contribute to the minimum aeronautical requirements specified in this section.

4.2An applicant for the issue of a flight instructor (helicopter) rating grade 2 must:

(a)hold a commercial pilot (helicopter) licence or an air transport pilot (helicopter) licence; and

(b)have at least 400 hours of flight time in a helicopter; and

(c)have completed a course of training in accordance with paragraph 4.2.1.

4.2.1The course of training mentioned in subparagraph 4.2 (c) must:

(a)include at least 40 hours of dual instruction given by a Grade 1 flight instructor; and

(b)be in accordance with the syllabus set out in paragraph 1 of Appendix I.

4.2.2In spite of subparagraph 4.2.1 (a), the course of training may include not more than 15 hours of mutual practice.

4.3An applicant for the issue of a flight instructor (helicopter) rating grade 1 must:

(a)hold a commercial pilot (helicopter) licence or an air transport pilot (helicopter) licence; and

(b)hold, or have held, a flight instructor (helicopter) rating grade 2; and

(c)have at least 1 200 hours of flight time as a pilot in a helicopter, being flight time that includes at least 400 hours during which the applicant gave elementary helicopter flying training.

  1. AERONAUTICAL KNOWLEDGE

5.1An applicant shall have, commensurate with the instructor grading sought, an adequate knowledge of:

(a)the principles and methods of instruction applicable to helicopters; and

(b)all theory subjects required for the issue of a commercial pilot (helicopter) licence; and

(c)the flight radiotelephone practical test requirements for the issue of flight radiotelephone operator licences.

5.2An applicant for a flight instructor (helicopter) rating grade 1 or flight instructor (helicopter) rating grade 2 shall have an adequate knowledge, depending on the instructor grading held, of the operational requirements for the proper conduct of a flying school.

  1. AERONAUTICAL SKILL

6.1An applicant must pass a flight test conducted by CASA, an approved testing officer or an approved person to demonstrate his or her ability to impart knowledge and to demonstrate techniques in any or all of the sequences required for the issue of a commercial pilot (helicopter) licence. Where the qualification sought includes instrument flying and night flying, the applicant may also be examined in these sequences.

  1. EXEMPTIONS

8.1If an applicant for a flight instructor (helicopter) rating grade 2:

(a)holds a flight instructor (aeroplane) rating grade 1 or a flight instructor (aeroplane) rating grade 2; or

(b)has held a flight instructor (aeroplane) rating grade 1 or a flight instructor (aeroplane) rating grade 2 within the period of 2 years immediately before the day on which he or she made the application;

CASA may give consideration to reducing the 40-hour course of helicopter flight instruction specified at paragraph 4.2 (c) to a minimum of 20 hours flight time, of which not less than 15 hours shall be dual instruction with a Grade 1 flight instructor and the remaining 5 hours may be dual instruction with a Grade 2 flight instructor or mutual practice between 2 trainee instructors.

8.2If the applicant for a flight instructor (helicopter) rating grade 2 has satisfactorily completed a course of training in the aeronautical knowledge and aeronautical skills of a flight instructor that was conducted:

(a)within the Defence Force of Australia; or

(b)within the Central Flying Schools of the Royal New Zealand Air Force or Royal Air Force;

he or she is exempt from compliance with subparagraph 4.2 (c).

8.3If the applicant for a flight instructor (helicopter) rating grade 2 has satisfactorily completed a course of training in the aeronautical knowledge and aeronautical skills of a flight instructor that was conducted within a Defence Force or Air Force, other than one listed in paragraph 8.2, he or she may apply in writing to CASA for exemption from compliance with subparagraph 4.2 (c).

8.4On receiving an application under paragraph 8.3, CASA may grant complete or partial exemption from compliance with subparagraph 4.2 (c) if satisfied that the aeronautical knowledge and aeronautical skills of the applicant make it unnecessary for him or her to complete, in whole or in part, a course of training under that subparagraph.

8.5If CASA is not satisfied of the matters referred to in paragraph 8.4, it must refuse to grant an exemption under paragraph 8.4.

8.6If the applicant for a flight instructor (helicopter) rating grade 2 who holds or has held an overseas instructor authorisation has received not less than 40 hours of flight instructor training in helicopters comprising:

(a)dual flight instruction received in the course of training for the issue of the overseas instructor authorisation which may include mutual practice with another trainee instructor; and

(b)not less than 10 hours dual flight instruction from a Grade 1 flight instructor at a flying school which has the approval to conduct instructor training endorsed on its AOC;

he or she is exempt from compliance with subparagraph 4.2 (c).

8.7In this subsection:

an overseas instructor authorisation means an authorisation that was issued by the responsible authority of a Contracting State to give flight instruction for an overseas helicopter licence that authorises a person to fly a helicopter in private operations as a pilot in command.

  1. DURATION

9.1For the purposes of subregulation 5.17 (3), a flight instructor (helicopter) rating grade 2 remains in force for the period of:

(a)1 year from the last day of the month in which the grade of rating was issued; or

(b)2 years from the last day of the month in which the grade of rating was renewed.

9.2For the purposes of subregulation 5.17 (3), a flight instructor (helicopter) rating grade 1 remains in force for the period of 2 years from the last day of the month in which the grade of rating was issued or renewed.

  1. RENEWAL

10.1A flight instructor rating may be renewed:

(a)if the rating is in force — the holder of the rating passes a flight test in accordance with paragraph 6.1 within the period of 90 days immediately before the day on which the rating expires; and

(b)if the rating has expired for a period of not more than 2 years — the holder of the rating passes a flight test in accordance with paragraph 6.1; and

(c)if the rating has expired for a period of more than 2 years — the holder satisfies the requirements of subsections 4, 5 and 6.

  1. AUTHORITY GIVEN BY RATING

11.1The holder of a flight instructor (helicopter) rating grade 2 may:

(a)under the direct supervision of an instructor employed by the same flying training organisation who is the holder of a flight instructor (helicopter) rating grade 1, give flying training in all sequences required for the issue of a commercial pilot  (helicopter) licence; and

(b)after having logged at least 150 hours of elementary helicopter flying training give flying training under the indirect supervision of a Chief Flying Instructor and, with the written approval of the Chief Flying Instructor, may authorise a student pilot to fly as pilot in command of a helicopter; and

(c)after having logged at least 250 hours of elementary helicopter flying training and having demonstrated to the satisfaction of CASA that he or she is capable of assessing the standard of instruction required to be achieved by a flying school and is capable of instructing to that standard — be approved to exercise some of the privileges of a Chief Flying Instructor; and

(d)if the instructor is approved under subregulation 5.20 (1) to give flying training for the issue of a helicopter pilot rating — under the direct supervision of a Grade 1 flight instructor give flying training for the issue of the rating; and

(e)subject to paragraph 11.5, give flying training for the issue of an aircraft endorsement for a helicopter, being an aircraft endorsement held by the instructor; and

(f)approve the holder of a private pilot licence to fly an aircraft in controlled airspace.

11.2The holder of a flight instructor (helicopter) rating grade 1 may:

(a)act as Chief Flying Instructor of a flying school training students to the commercial pilot (helicopter) licence standard; and

(b)give flying training in all sequences required for the issue of a commercial pilot (helicopter) licence; and

(ba)authorise a student pilot to fly as pilot in command of a helicopter; and

(c)instruct trainee instructors in flight instructional techniques and briefing methods as directed by the Chief Flying Instructor; and

(d)direct and certify in accordance with the requirements of paragraph 11.1; and

(e)if the instructor is approved under subregulation 5.20 (1) to give flying training for the issue of a helicopter pilot rating — give flying training for the issue of the rating; and

(ea)subject to paragraph 11.5, give flying training for the issue of an aircraft endorsement for a helicopter, being an aircraft endorsement held by the instructor; and

(eb)conduct a helicopter flight review; and

(ec)approve the holder of a private pilot licence to fly an aircraft in controlled airspace; and

(f)make recommendations to CASA for the upgrading of Grade 2 flight instructors; and

(g)if approved by CASA, act as Chief Flying Instructor of a flying school training students for the issue of a flight instructor (helicopter) rating.

11.3The holder of a flight instructor (helicopter) rating must not:

(a)give flying training at night; or

(b)give flying training in basic instrument flight;

unless he or she:

(c)has completed a course of training in accordance with paragraph 11.3.1; or

(d)is exempt under paragraph 8.2, or has been granted an exemption under paragraph 8.4, from compliance with subparagraph 4.2 (c).

11.3.1The course of training mentioned in paragraph 11.3 must:

(a)include at least 10 hours of dual instruction given by a Grade 1 flight instructor; and

(b)be in accordance with the syllabus set out in section 2 of Appendix 1.

11.3.2In spite of subparagraph 11.3.1 (a), the course of training may include not more than 4 hours of mutual practice.

11.5The holder of a flight instructor (helicopter) rating may give flying training in multi-engine and multi-rotor helicopters only if he or she has:

(a)in the case of the multi-engine helicopters at least 50 hours as pilot in command of helicopters in this category of which at least 25 hours have been gained as pilot in command on each type of helicopter in which he or she wishes to give training, or such other types as CASA determines as being similar; and

(b)in case of multi-rotor helicopters at least 100 hours as pilot in command of helicopters in this category of which at least 25 hours have been gained as pilot in command on each type of helicopter in which he or she wishes to give training, or other such types as CASA determines as being similar; and

(c)been certified as competent to do so by CASA.

11.6A person, other than a Chief Flying Instructor, who holds a flight instructor (helicopter) rating must not give flying training unless, during the period of 12 months immediately before the day on which it is proposed to give the training, the person has satisfactorily completed a standardisation and proficiency flight check conducted by the Chief Flying Instructor of the flying school at which the flying training is to be conducted.

11.7The results of a standardisation and proficiency flight check must be recorded in the person’s log book and must be certified by the Chief Flying Instructor who conducted the check.

  1. LOGBOOK ENDORSEMENTS

12.2The circumstances under which student pilot logbook endorsements shall be made and the forms of endorsements are specified at Appendix II to this section.

  1. TRAINING IN ACTIVITIES FOR WHICH A RATING IS REQUIRED

13.1The holder of a pilot licence who holds a flight instructor (helicopter) rating is approved under subregulation 5.20 (1) to give flying training for the issue of:

(a)if he or she holds a command (multi-engine helicopter) grade of instrument rating:

(i)a command (multi-engine helicopter) grade of instrument rating; or

(ii)a command (single engine helicopter) grade of instrument rating; or

(iii)a co-pilot (helicopter) instrument rating; and

(b)if he or she holds a command (single engine helicopter) grade of instrument rating:

(i)a command (single engine helicopter) grade of instrument rating; or

(ii)a co-pilot (helicopter) grade of instrument rating; and

(c)if he or she holds a co-pilot (helicopter) grade of instrument rating — a co-pilot (helicopter) grade of instrument rating.

13.2For the purposes of subregulation 5.20 (2), it is a condition of an approval under paragraph 13.1 that the person approved may only give flying training for a helicopter grade of instrument rating using the navigation aids which the person is authorised to use by his or her helicopter grade of instrument rating.

13.3The holder of a pilot licence who holds a flight instructor (helicopter) rating is approved under subregulation 5.20 (1) to give flying training for the issue of a helicopter grade of night V.F.R. rating if he or she:

(a)holds a helicopter grade of night V.F.R. rating; and

(b)has completed the course of training mentioned in paragraph 11.3.

SYLLABUS OF TRAINING FOR FLIGHT INSTRUCTOR

(HELICOPTER) RATING

  1. 40 Hour Syllabus for day only instruction:

    Familiarisation with helicopter and air experience.

    Preparation for flight and after flight.

    Effect of controls.

    Power and attitude changes.

    Climbing, level flight and descending including turns.

    Autorotation.

    Hovering.

    Transitions.

    Take-off, circuit and landing.

    Sideways and backwards flight.

    Air and ground taxiing.

    Spot turns.

    Autorotative landings.

    Incipient vortex ring state and recovery.

    Forced landings.

    Steep turns.

    Low flying.

    Pilot navigation.

    Sloping ground and out of wind operation.

    Quick stops.

    Limited power operation.

    Confined area operation.

  2. Additional 10 hour Syllabus for night instruction:

    Basic Instrument Flying.

    Night Flying.


APPENDIX II

FLIGHT INSTRUCTOR (HELICOPTER) RATING LOGBOOK

ENDORSEMENTS

  1. Student Pilot:

Check of flight times: All student pilots’ logbooks shall be checked and signed by an instructor at the following times:

(a)monthly;

(b)on completion of course;

(c)on leaving a particular flying school.

Form: Flying times with the ‘Melbourne Flying School’ correct to date, A.B. Smith (No. 2146) 20 October 1988.

  1. General:

2.1First solo flight in a particular type of helicopter (Day/Night)*: A pilot shall not be permitted to make his or her first solo flight, by day or night unless an instructor deems him or her competent to make the flight. The instructor shall, immediately following the flight, certify to this effect in the pilot’s logbook.

Form: I consider X.Y. Jones competent to fly solo by day/night* in ..................... type helicopter/s. He/she has been instructed in and found competent in all sequences for this solo flight. A.B. Smith (No. 2146) 20 October 1988.

2.2Student’s solo-authorisation: In accordance with paragraph 11.1 (b) a Chief Flying Instructor shall certify to the competency of a Grade 1 flying instructor to authorise student’s solo flights.
