1Name of Regulations

These Regulations are the Civil Aviation (Fees) Amendment Regulations 2004 (No. 1).

2Commencement

These Regulations commence on the date of their notification in the Gazette.

3Amendment of Civil Aviation (Fees) Regulations

Schedule 1 amends the Civil Aviation (Fees) Regulations.

4Transitional

The amendments by regulation 3 do not affect the fee payable by a person for a service if:

1. (a)

   in the case of a service for which the fee is the hourly rate:

   1. (i)

      CASA began to provide the service to the person before the commencement of the amendments; or

   2. (ii)

      CASA agreed with the applicant in writing, before the commencement of the amendments, to provide the service at the hourly rate prevailing at that time; or

2. (b)

   in the case of any other service — the person paid the fee before the commencement of the amendments.
