503 ANNO NONODECIMO ELIZABETHAE SECUNDAE REGINAE No. 38 of 1970 An Act to Amend The Civil Aviation (Carriers' Liability) Act of 1964 in a certain particular [ASSENTED TO 18TH DECEMBER, 1970] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Civil Aviation (Carriers' Liability) Act Amendment Act 1970. (2) The Civil Aviation (Carriers' Liability) Act of 1964 is in this Act referred to as the Principal Act. (3) The Principal Act, as amended by this Act, may be cited as the Civil Aviation (Carriers' Liability) Act1964-1970. 2. Amendment of s. 4 .-Carriage to which Act applies . Section 4 ,of the Principal Act is amended by omitting all words after " airline licence " and inserting in their stead the following words:- or a charter licence in the course of commercial transport operations under a contract for the carriage of the passenger- (a) between a place in Queensland and another place in Queensland; or

504 Civil Aviation ( Carriers ' Liability ) Act Amendment Act 1970, No. 38 (b) in the case of the holder of a charter licence, beginning at a place in Queensland and ending at that place without any intermediate landing or landings at any other place or places, not being carriage to which Part IV of the Commonwealth Act applies or to which the Warsaw Convention, or the Warsaw Convention as affected by the Hague Protocol and by the Guadalajara Convention, applies." 3. Application of amendments . (1) The amendment made by this Act does not apply in relation to an accident or occurrence that took place before the commencement of this Act. (2) The amendments made to the provisions of Part IV of the CivilAviation (Carriers' Liability) Act1959-1962 of the Commonwealth by the Civil Aviation (Carriers' Liability) Act1970 and applying by virtue of the CivilAviation (Carriers' Liability) Act1964-1970 do not apply in relation to an accident or occurrence that took place before the commencement of the Civil Aviation (Carriers' Liability) Act1970 of the Commonwealth.
